Caros amigos,
Segundo juristas de elevado renome, a restrição de direitos e a concentração de poderes promovidas por Ministros do STF, fora e além dos limites das suas atribuições, colocaram o Brasil em um ESTADO DE EXCEÇÃO QUE PODE E DEVE SER REVERTIDO antes do fim deste mandato.
A Constituição Federal de 1988 (CF/88) estabelece, no seu Artigo 37, que todos os atos da administração pública devem obedecer a princípios fundamentais, quais sejam, a legalidade, a impessoalidade, a moralidade, a publicidade e a eficiência.
A Legalidade impõe que todos e quaisquer atos dos agentes públicos devem ser respaldados na lei, caso contrário serão considerados ilícitos. A Impessoalidade inibe privilégios, interesses ou discriminações nos atos públicos. A Moralidade exige elevados padrões éticos de probidade, decoro e boa-fé dos agentes públicos e de seus atos. A Publicidade estipula que todos os atos e atividades de interesse público devem ser divulgados para que a sociedade exerça o seu controle sobre eles. E, finalmente, o princípio da Eficiência estabelece que o serviço público deve atender aos anseios da sociedade e atingir os resultados a que se propõe.
Estes princípios, portanto, disciplinam o modo de agir e a conduta dos agentes do Estado em todas as suas ações e, por isso mesmo, são FUNDAMENTAIS.
Por outro lado, no seu Artigo 78, a CF/88 estabelece que O PRESIDENTE DA REPÚBLICA e seu Vice TÊM O DEVER DE manter, DEFENDER e cumprir A CONSTITUIÇÃO, observar as leis, promover o bem geral do povo, sustentar a união, a integridade e a independência do Brasil.
SALVO OUTRO JUÍZO, baseado nestes dois artigos, O PRESIDENTE DA REPÚBLICA TEM, mais do que o direito, O DEVER DE EXIGIR DO TSE A ENTREGA DO CÓDIGO FONTE da apuração desta última eleição para o Ministério da Defesa, conforme este último já lhe solicitou, para que todas as dúvidasque pairam sobre o processo sejam dirimidas.
Caso o Tribunal, na pessoa do agente público que exerce a função de seu Presidente, não cumpra a exigência do Chefe do Poder Executivo, ele estará descumprindo princípios fundamentais estabelecidos no Artigo 37 e compulsando o Presidente da República a, baseado no dever estabelecido pelo Artigo 78, empregar o poder coercitivo do Estado para que o requerimento seja atendido.
Saindo da tese para o fato, se o Ministro Alexandre de Moraes negar-se a entregar e abrir o CÓDIGO FONTE da apuração, conforme solicitado pelo Presidente Jair Bolsonaro, por intermédio do Sr Ministro da Defesa, General Paulo Sérgio de Oliveira, o Presidente Bolsonaro será compulsado pelo Artigo 78 a usar outros meios constitucionais para que a ordem seja mantida, a lei seja cumprida e sua demanda seja atendida.
Em resumo, CABE AO PRESIDENTE BOLSONARO, no uso do seu dever constitucional, por todos os meios e a qualquer custo, EXIGIR A ENTREGA DO CÓDIGO FONTE, para que o resultado da eleição seja auditado pelo Ministério da Defesa, conforme a sua determinação, dando início à reversão do Estado de Exceção a que o País está sendo submetido.
