Deputado federal eleito e ex-procurador da Lava Jato foi incluído ilegalmente em cobrança
A 6ª Vara Federal de Curitiba (PR) anulou o acórdão do Tribunal de Contas da União (TCU) que condenou o ex-procurador e deputado federal eleito Deltan Dallagnol (Podemos-PR) ao pagamento de R$ 2,8 milhões, pelas chamadas “Diárias da Lava Jato”. A decisão foi tornada pública nesta segunda-feira (5).
O parlamentar eleito comemorou: “Não foi só o Brasil que ganhou de goleada da Coreia do Sul na Copa do Mundo, mas a Justiça também fez um grande gol de placa ao dar um basta à perseguição contra mim no TCU”, disse.
Segundo o juiz federal Augusto César Pansini Gonçalves, que deu hanho de causa ao ex-procurador, Dallagnol não é parte ativa no caso e, portanto, não poderia ser incluído na cobrança feita pelo TCU junto ao ex-procurador-geral Rodrigo Janot e o ex-procurador-chefe do MP no Paraná, José Vicente Beraldo Romão.
Para o juiz, na decisão do TCU tomada no início de agosto, o ministro Bruno Dantas, relator do caso e presidente da corte, teria desconsiderado manifestações da área técnica do TCU, contra a condenação.
“É preciso ressaltar também que o relator do processo, Ministro Bruno Dantas, antes mesmo de levá-lo à apreciação colegiada (na verdade, antes mesmo da instauração da Tomada de Contas Especial), pareceu prejulgar o caso, e em termos peremptórios, denotando, com esse comportamento, uma suposta falta de impessoalidade”, escreveu o juiz federal.
O caso
Procuradores de outras cidades foram indicados para atuar na “lava jato” em Curitiba e receberam ajuda financeira em uma situação provisória de trabalho, em vez de serem oficialmente transferidos para a capital paranaense.
O ministro Bruno Dantas, relator do processo no TCU, inimigo da operação Lava Jato considerou que faltaram estudos mínimos para avaliar alternativas e demonstrar tecnicamente que o modelo de gestão adotado era “o que melhor atendia ao interesse público”.
Na época da Condenação, Deltan escreveu em nota:
“A decisão dos ministros desconsidera o parecer de 14 manifestações técnicas de 5 diferentes instituições (MPF, TCU, MP-TCU, ANPR e JF) que referendaram a atuação da Lava Jato e os pagamentos feitos. Tudo isso com o objetivo de perseguir o ex-procurador Deltan Dallagnol e enviar um claro recado a todos aqueles que lutam contra a corrupção e a impunidade de poderosos.

Discordando dos 4 ministros políticos do TCU que condenaram Deltan Dallagnol, todos delatados na Lava Jato, o ministro substituto André Luis, que veio da área técnica e não tem direito a voto, no fim do julgamento, pediu a palavra para elogiar ironicamente o ministro relator Bruno Dantas pela coragem de condenar quem combateu a corrupção, contra as manifestações técnicas, enquanto os tribunais estão livrando a cara de quem realmente praticou corrupção.“
