Suprema Corte forma maioria de votos considerando emendas de relator como inconstitucionais
Gilmar Mendes votou, nesta segunda-feira (19), pela regulamentação das emendas de relator-geral no orçamento da União. Seu voto, o último do julgamento, conclui a decisão da Suprema Corte contra as RP-9, que sustentaram o chamado “orçamento secreto”.
Em sua explicação, o decano da Suprema Corte disse que, com as emendas do relator, a própria função do Legislativo se perde. “Com o protagonismo das emendas do relator-geral, corre-se o risco de as emendas passarem a programar a administração pública, ditando-lhe as prioridades”, refletiu o ministro. “Passa a se adotar um modelo de parlamentarismo ou semipresidencialismo sem as características de um novo regime de governo.”
Mendes ainda disse que tais emendas foram gradualmente sendo tornadas “impositivas” pelo parlamento brasileiro, sinal de um “debilitamento do poder Executivo, que de alguma maneira se materializa na adoção da RP-9 com caráter impositivo.”
Ele, no entanto, divergiu da ministra para abrir a possibilidade de regulamentação das emendas parlamentares, tornando os repasses rastreáveis e identificáveis em até 30 dias. No entanto, seu encaminhamento acabou vencido, já que a corte formou maioria pela inconstitucionalidade da norma.
Com isso, ao final do julgamento, votaram pela inconstitucionalidade Lewandowski, Cármen Lúcia, Fux, Barroso, Fachin e a relatora, Rosa Weber. Uma segunda corrente, formada Gilmar Mendes, Dias Toffoli, Nunes Marques, Mendonça e Moraes, sugeriu alterações na regulamentação dessas emendas.
