Ministro do STF disse que Justiça Militar é incompetente para processar e julgar militares que estejam envolvidos nas manifestações que viraram vandalismo
O ministro do Supremo Tribunal Federal (STF), Alexandre de Moraes estabeleceu que o STF é o responsável por processar e julgar integrantes das Forças Armadas e de Policiais Militares envolvidos nos atos de vandalismo ocorridos no dia 8 de janeiro deste ano.
Além disso, o magistrado também determinou a abertura de inquérito para apurar a conduta dos militares.
A investigação, até o momento, estava sendo conduzida pela Justiça Militar. Contudo, Moraes argumentou que “inexiste competência da Justiça Militar da União para processar e julgar militares” envolvidos neste caso. Na visão do ministro, a Justiça Militar não tem competência para processar crimes como atentados ao Estado Democrático de Direito, ameaça, dano, incitação ao crime, associação criminosa, entre outros.
Para o magistrado, a Justiça Militar somente tem competência para processar os chamados crimes militares, como insubordinação, ou desvios de conduta relacionados à atividade na Polícia Militar ou Forças Armadas.
“Nenhuma das hipóteses definidoras da competência da Justiça Militar da União está presente nessa investigação, pois os citados artigos do Código Penal Militar não se confundem com a responsabilidade penal prevista pela Lei 13.260/16 ou pelos tipos penais anteriormente citados e tipificados no Código Penal”, disse Moraes.
“Absolutamente todos os envolvidos serão responsabilizados civil, política e criminalmente pelos atos atentatórios à Democracia, ao Estado de Direito e às Instituições, inclusive pela dolosa conivência por ação ou omissão motivada pela ideologia, dinheiro, fraqueza, covardia, ignorância, má-fé ou maucaratismo”, reafirmou Moraes.
