O ex-secretário de Segurança Pública do DF, Anderson Torres não irá à Comissão Parlamentar de Inquérito (CPI) da Câmara Legislativa do Distrito Federal (CLDF) que investiga os atos de vandalismo em Brasília. O depoimento estava previsto para esta quinta-feira (9).
A informação foi dada pela defesa de Torres na manhã desta quarta-feira (8). “A condução do Dr. Anderson Torres à CPI seria de todo inútil, uma vez que ele já depôs à Polícia Federal – por mais de 10 horas – sobre todos os temas investigados pelo Parlamento distrital”, afirmou o advogado Rodrigo Roca.
Na terça-feira (7), o ministro do Supremo Tribunal Federal (STF) Alexandre de Moraes havia liberado Anderson Torres para ir à CPI, se quisesse. Na mesma decisão, o ministro autorizou que Torres permanecesse em silêncio na oitiva.
“Autorizo a liberação de Anderson Gustavo Torres, para realização de seu depoimento no dia 09/03/2023 às 10:00 horas, em sessão da Câmara Legislativa do Distrito Federal, garantindo-se, plenamente, seu direito ao silêncio, nos termos consagrados constitucionalmente. Observo, entretanto, que a condução de Anderson Torres, que encontra-se preso preventivamente, deverá ser feita mediante escolta policial e somente ocorrerá se houver sua prévia concordância”, escreveu Moraes.
A decisão é uma resposta aos pedidos da CLDF para que o ex-ministro de Justiça fosse liberado para comparecer à CPI.
A Comissão teve início em 2 de março com o depoimento de Fernando de Sousa Oliveira, ex-secretário executivo da Secretaria de Segurança Pública do Distrito Federal (SSP). Fernando, que era secretário em exercício da SSP-DF no dia da tentativa de golpe, afirmou que Anderson Torres saiu de férias sem deixar “nenhuma orientação específica” sobre os atos.
Argumentos da defesa

Os advogados argumentam que não existe interesse em comparecer à CPI pois, “apesar de o investigado possuir ampla e incondicional disposição de esclarecer os fatos que vêm sendo indevidamente imputados em seu desfavor, já se desincumbiu dessa missão quando, por mais de dez horas, prestou depoimento nestes autos de inquérito”.
Em 28 de fevereiro, a CLDF, por meio da Procuradoria-Geral da Casa, pediu ao STF a liberação de Anderson Torres para que seja ouvido pela CPI.
Torres foi preso por possível omissão durante invasão e depredação das sedes dos Três Poderes, em 8 de janeiro. À época, ele estava nos Estados Unidos.
O ex-secretário foi detido em 14 de janeiro, logo que desembarcou no Brasil, e permanece encarcerado nas instalações do Batalhão de Aviação Operacional, no 4º Batalhão de Polícia Militar do Distrito Federal (PMDF).
