O Tribunal de Justiça do Rio de Janeiro (TJRJ) acatou a solicitação do Banco Safra e suspendeu, em medida liminar, o pagamento antecipado de dívidas com trabalhadores e credores de pequeno porte das Lojas Americanas. Os pagamentos antecipado havia sido autorizado pela 4ª Vara Empresarial do Rio, no início da semana passada. Esses débitos somam R$ 192 milhões.
No pedido, o banco argumentou que o pagamento antecipado é “incompatível com as normas processuais”, estabelecidas pela Lei de Recuperação de Empresas (LRE). A Americanas, por sua vez, havia argumentado que o valor desses dois tipos de débitos é pequeno em relação à dívida total da companhia, estimada em R$ 42,5 bilhões.
Na prática, o Safra quer que os pagamentos só sejam retomados após a aprovação do plano de recuperação judicial da empresa, iniciada em 19 de janeiro, que conte com o aval dos credores.
Em nota, a Americanas informou que “respeita a decisão proferida pelo Tribunal de Justiça do Rio de Janeiro e deu a ela cumprimento imediato tão logo cientificada”. A seguir, apontou: “A companhia reafirma a sua convicção na razoabilidade e na correção do seu pedido de pagamento antecipado das classes I e IV, formadas, majoritariamente, por credores trabalhistas e por micro e pequenas empresas, como forma de minimizar o impacto socioeconômico decorrente de sua recuperação judicial. A companhia informa ainda que está avaliando as medidas jurídicas cabíveis”.
