A Polícia Federal deflagrou, na manhã desta terça-feira (25/4), uma operação para desarticular uma organização criminosa especializada em fraudar benefícios do INSS e falsificar documentos. A quadrilha alvo da operação Metamorfose já causou à Previdência Social prejuízo de aproximadamente R$ 8 milhões, sendo que os valores poderiam alcançar R$ 12,2 milhões pelo prazo de duração restante dos benefícios recolhidos ilegalmente.
Cerca de 100 policiais federais cumprem 19 mandados de prisão preventiva e 18 mandados de busca e apreensão, expedidos pela 7ª Vara Federal Criminal do Rio de Janeiro, nos municípios do Rio de Janeiro, Niterói (RJ), Nova Iguaçu (RJ) e Nilópolis (RJ).
Durante as investigações, que contaram com o apoio do Núcleo de Inteligência do Ministério da Previdência Social no Rio de Janeiro e da Centralizadora de Prevenção a Fraudes da Caixa, foi identificado um massivo esquema de fraudes contra o INSS que proporcionava a obtenção de diversos benefícios previdenciários em nome de pessoas “fictícias” ou falecidas. Foram fraudados os benefícios do tipo pensão por morte e BPC-LOAS (benefício de prestação continuada ao idoso hipossuficiente).
Segundo a PF, o grupo criminoso operava mediante a realização de requerimentos de benefícios previdenciários em nome de pessoas “fictícias”, além da reativação de benefícios titularizados por pessoas já falecidas. Para tanto, a quadrilha anexava junto aos processos concessórios farta documentação falsificada.
Entretanto, como se tratavam de titulares “fantasmas” ou falecidos, a quadrilha apenas conseguia sucesso na empreitada criminosa por conta da atuação de seus integrantes, que se habilitavam como procuradores e faziam requerimentos na condição de representantes legais desses beneficiários “inexistentes”.
Uma vez concedido o benefício, tais procuradores realizavam a abertura de contas em agências bancárias, proporcionavam os saques dos valores e retiravam o cartão magnético para saques futuros. Verificou-se, assim, que além de atuarem como procuradores de pessoas “fictícias”, os criminosos se apresentavam perante o INSS como se fossem outra pessoa, visto que alguns integrantes da quadrilha forjaram a própria identidade.
Os criminosos responderão, entre outros delitos, pelos crimes de organização criminosa, estelionato previdenciário, falsidade ideológica, falsificação de documentos públicos e uso de documentos falsos. Se somadas, as penas podem chegar a 31 anos e 8 meses de reclusão.
O nome escolhido da operação se deu pelo modo de atuação da quadrilha, que buscava “transformar” a identidade dos criminosos para obter benefícios fraudulentos, como uma espécie de metamorfose, que deriva do grego “metamorphosis” e significa transformação.
