Ministro do STF atendeu pedido do próprio presidente da Câmara
O ministro do Supremo Tribunal Federal (STF) Gilmar Mendes ordenou nesta quinta-feira (6) a suspensão da Operação Hefesto e determinou que a Polícia Federal (PF) envie à corte a investigação dos kits de robótica que atinge o ex-assessor do presidente da Câmara dos Deputados, Arthur Lira (PP), Luciano Ferreira Cavalcante.
O ministro atendeu a pedido do próprio presidente da Câmara, datado do início desta semana. Segundo Gilmar Mendes, há possível “violação à prerrogativa de foro” do deputado. A decisão foi dada no que é considerado o “Dia D” para aprovar o texto da reforma tributária na Casa.
A PF apura crimes na compra de kits de robótica para 43 municípios de Alagoas, entre 2019 e 2022, com recursos desviados do FNDE. A Controladoria calcula que as fraudes e superfaturamento geraram prejuízo de 8,1 milhões de reais aos cofres públicos.
Ao todo, foram cumpridos até agora, 27 mandados de busca e apreensão e dois de prisão em quatro estados e no Distrito Federal no início de junho.
A suspensão alegando motivo de foro, acontece, mesmo depois de a PF já ter decidido enviar a investigação ao STF, após encontrar anotações de uma série de pagamentos e referências a “Arthur”. Além disso, ontem, o juiz federal substituto Roney Raimundo Leao Otilio, da 2ª Vara Federal da Justiça Federal de Alagoas, determinou o envio, ao Supremo Tribunal Federal (STF), da investigação da operação Hefesto, que apura as fraudes em licitação e lavagem de dinheiro na compra de equipamentos de robótica para 43 municípios alagoanos.
Segundo o juiz, a Polícia Federal apontou suposto envolvimento do presidente da Câmara dos Deputados, Arthur Lira (PP-AL), que tem foro privilegiado, por isso, houve a imediata suspensão das investigações e envio do caso ao tribunal competente para investigar e julgar parlamentares.
“Havendo indícios da participação nos delitos ora investigados de um congressista, a competência desse juízo se encerra”, afirmou o magistrado na decisão de ontem.
