Construtora diz que pagou em dinheiro vivo a filha de ministro do STJ

Empresa acusa filha do ministro Marco Buzzi (STJ) de receber R$ 1,1 milhão por consultoria não prestada, antes de retirar carteira da OAB

Segundo o site Metrópoles, uma construtora sediada em Brasília acionou a Justiça do Distrito Federal para cobrar a devolução de R$ 1,1 milhão que afirma ter pago à advogada Catarina Buzzi, filha do ministro Marco Buzzi, do Superior Tribunal de Justiça (STJ), por uma “consultoria jurídica” que não teria sido prestada.

No processo, obtido pelo site, a Indústria de Mineração e Construção Brasil afirma que parte do pagamento, no valor de R$ 220 mil, foi feita em dinheiro vivo, no escritório de Catarina, em Brasília. O restante teria sido transferido para duas contas bancárias: a de uma administradora empresarial e a da banca de advocacia de uma parceira da filha do magistrado.

A construtora diz que contratou Catarina para a “prestação de serviços de assessoria e consultoria jurídica” em uma disputa por um imóvel de R$ 6,3 milhões comprado dos Correios em leilão. O caso tramita na Justiça Federal de Minas Gerais.

O ministro Marco Buzzi, pai da advogada, julga outras causas relacionadas a sócios da construtora. Em uma delas, da qual ele é relator e na qual já negou o recurso da empresa, o magistrado foi acionado pelo time de advogadas da construtora, para que se declarasse suspeito por causa da suposta dívida de sua filha.

A empresa ainda acusa a filha do ministro do STJ de fazer um “contrato verbal”, sem informar que ainda não tinha a carteira da Ordem dos Advogados do Brasil (OAB). Esse documento é exigido por lei para quem exerce a profissão de advogado. A negociação teria ocorrido em novembro de 2022. Aos 35 anos, Catarina só foi aprovada na OAB em janeiro deste ano. A empresa diz que vai fazer uma representação junto à entidade por exercício ilegal da advocacia.

A ação de cobrança foi ajuizada em julho, na 6ª Vara Cível de Brasília. Nela, a construtora anexou prints de supostas mensagens de WhatsApp nas quais Catarina e uma parceira dela tratam do contrato e dos pagamentos.

O valor acertado — R$ 1,1 milhão — corresponde a 19% do valor da causa para a qual a empresa alega tê-la contratado. Todo o pagamento foi feito adiantado, segundo a empresa.

Para o mesmo serviço, após o distrato com a filha do ministro, um advogado foi contratado por R$ 20 mil. Ele só receberá mais R$ 1 milhão se tiver êxito na ação em Minas Gerais.

Nos prints anexados ao processo, uma mensagem atribuída a Catarina mostra a filha do ministro agradecendo o envio do comprovante de uma transferência bancária no valor de R$ 300 mil: “Amém Jesus. Temos que ver como o senhor não explicar isso depois” (sic).

Em seguida, ela diz: “E o restante em dinheiro, o senhor me manda quando?”. O representante da empresa propõe que o valor seja pago na segunda-feira seguinte, por TED, ou na terça, em dinheiro. Ela responde: “Não. Terça em dinheiro tá ótimo”. A empresa afirma ter levado R$ 220 mil em dinheiro vivo para o escritório da filha do ministro.

Segundo a construtora, Catarina estava “ajudando” a empresa “para não dar problema”, o que justificaria a transferência de “valores maiores” à advogada. Em março de 2023, a empresa passou a dizer que nenhum serviço foi prestado e fez uma cobrança extrajudicial. No mês passado, acionou a Justiça.

Empresas da família dona da construtora têm diversas causas no Superior Tribunal de Justiça. Pelo menos três estão na Quarta Turma do STJ, responsável por julgar casos empresariais e de direito privado.

Em duas das causas, de 2022 e 2023, o pai de Catarina negou os recursos impetrados pela construtora. Ele ainda não decidiu se está suspeito, ou não, para julgar o processo que resta, movido pela ex-esposa do dono da empresa.

O empresário Wellington Chaves, filho do dono da Indústria de Mineração e Construção Brasil, afirma que Catarina e a sócia “receberam pelo que não fizeram” e admite que, embora o contrato tenha sido feito para uma atuação na Justiça Federal em Minas Gerais, eles conversaram também sobre processos no STJ, órgão do qual o pai da advogada é ministro.

“Sobre processos que envolvem o STJ, foi conversado e não se evoluiu nada. Qual era o primeiro serviço que ela tinha conosco, com a empresa do meu pai? Era esse que ela recebeu. Ficou de mandar o contrato e ficou o contrato verbal e o contrato nas mensagens. Nenhum outro processo evoluiu”, disse.

“Mandamos o dinheiro conforme ela pediu. Nesse modelo de negócio, não tem ninguém favorecendo ninguém. Foi contratado um serviço advocatício, o serviço não foi cumprido, e elas receberam pelo que não fizeram”, completa.

A advogada Catarina Buzzi afirmou ao site Metrópoles que “a história é fantasiosa”.

“As ilações apresentadas são inverídicas e infundadas. Serão todas desmentidas na Justiça. Lamentamos que esse tipo de denúncia vazia, destinada a constranger a honra e a imagem de advogados, continuem a repercutir”, afirmou.

Após a publicação da reportagem, a advogada enviou uma nova nota acrescentando que “nunca advogou para a empresa”, que as mensagens de WhatsApp anexadas ao processo “são forjadas” e que “Catarina não é a interlocutora das conversas”.

“Na sua avaliação, a construtora está tentando, por meio da polêmica infundada, fabricar a suspeição de magistrados”, diz a nota.

Já o ministro Marco Buzzi afirmou, por meio da assessoria do STJ, que “os recursos apresentados pela empresa foram negados, o que afasta, por completo, eventual suposição de favorecimento da parte”.

A nota acrescenta, ainda, que o processo movido pela ex-mulher do dono da empresa, do qual o ministro é relator, “teve o mérito julgado em colegiado em outubro de 2022, com decisão também desfavorável aos seus interesses”.

Por fim, a assessoria do STJ afirma que o pedido de suspeição do ministro Marco Buzzi  disse na sexta-feira que “chegou ao gabinete apenas na tarde de hoje, e será oportunamente analisado pelo ministro”.
