Inquérito 4921 apura os autores intelectuais dos atos antidemocráticos contra o STF, o Palácio do Planalto e o Congresso
O ministro do Supremo Tribunal Federal (STF), Alexandre de Moraes, determinou que as plataformas de redes sociais enviem à Procuradoria Geral da República (PGR) a íntegra das postagens nos perfis de Jair Bolsonaro sobre eleições, urnas eletrônicas, Tribunal Superior Eleitoral (TSE), Supremo, Forças Armadas, além de fotos e vídeos relacionados a esses assuntos.
A decisão foi tomada no Inquérito 4921, que apura os autores intelectuais e instigadores dos atos antidemocráticos contra o STF, o Palácio do Planalto e o Congresso Nacional. A PGR sustentou a necessidade de apuração global de condutas de Bolsonaro antes e depois de 8 de janeiro, para avaliar se houve incitação aos atos e a possível extensão dos danos provocados pelas informações postadas.
Moraes também atendeu ao pedido de que a empresa Meta envie à PGR vídeo postado e apagado no perfil de Bolsonaro no Facebook, cujo conteúdo foi preservado por decisão do STF. “Na conduta registrada em vídeo, verifica-se a presença de elementos indicativos de materialidade delitiva, bem como indícios de autoria, relativamente ao delito do art. 286 do Código Penal, de modo que o conjunto indiciário já angariado nos autos traz à baila a necessidade de intervenção estatal, com a imposição de medidas necessárias à sua apuração”, argumenta o magistrado.
A PGR sustenta que há conexão entre os fatos apurados no inquérito e as condutas atribuídas a Bolsonaro e é “imprescindível a realização das diligências requeridas pela PGR, inclusive com a relativização excepcional de garantias individuais, que não podem ser utilizadas como escudo protetivo para a prática de atividades ilícitas.’
