Genivaldo Santos foi assassinado por agentes que o trancaram no camburão e jogaram gás lacrimogêneo
A Justiça Federal em Sergipe determinou, nesta terça-feira (12), que a União pague uma indenização por danos morais no valor de R$ 1 milhão para o filho de Genivaldo Santos, de 38 anos, morto durante abordagem da Polícia Rodoviária Federal de Sergipe, em maio de 2022.
Genivaldo foi trancado no porta-malas de uma viatura da PRF e submetido à inalação de gás lacrimogêneo que o matou.
O juiz Rafael Soares Souza também determinou pagamento de uma pensão no valor de dois terços do salário mínimo, cerca de R$ 800 por mês. Ele decidiu ainda que Maria Fabiana Santos, não teria direito a indenização por não ficar comprovado, no seu entendimento, que ela seria viúva da vítima, embora Fabiana já estivesse sido reconhecida como companheira de Genivaldo na esfera estadual. A união do casal era questionada pelo Advocacia Geral da União no processo de indenização.
A advogada de Fabiana e do filho do casal, Priscilla Mendes, informou que vai recorrer da decisão. Ela disse ainda que não existe um prazo para o pagamento da indenização, e que esse processo pode levar anos.
Também nesta terça-feira (12), a Advocacia Geral da União (AGU) informou que um acordo foi firmado na Justiça Federal em Sergipe para que a União pague R$ 405 mil a mãe da vítima, Maria Vicente de Jesus, em razão dos atos de violência policial na ação. Do total, R$ 400 mil são referentes a indenização por dano moral e outros R$ 5 mil dizem respeito a danos materiais com o sepultamento de Genivaldo.
Um pouco mais de um ano após da morte da vítima, o julgamento dos agentes William de Barros Noia, Kleber Nascimento Freitas e Paulo Rodolpho Lima Nascimento, envolvidos na ação, ainda não tem data para acontecer. A Justiça Federal de Sergipe determinou que eles sejam submetidos à júri popular, o que é questionado pelas defesas.
Só em agosto deste ano l é que aconteceu a demissão dos três policiais rodoviários federais envolvidos no assassinato de Genivaldo Santos.
