O Conselho Institucional do MPF anulou nesta quarta-feira (13), por 17 votos a 2, o desconto de R$ 6,8 bilhões concedido pelo sub-procurador da PGR, Ronaldo Albo no acordo de leniência do grupo J&F, de Joesley Batista.
Os conselheiros ignoraram a manobra feita pelo aliado do procurador-geral, Augusto Aras, que havia tentado retirar o caso do órgão e impedir a análise do desconto nesta quarta.
Em votação preliminar e sigilosa, o Conselho do MPF decidiu que o corregedor nacional do MP, Oswaldo D’Albuquerque, não poderia chamar o caso para si, já que o processo não tem natureza disciplinar. Na prática, o resultado marcou uma dura derrota para a gestão de Augusto Aras.
A reclamação ao Conselho Institucional do MPF foi feita pelo procurador da República Carlos Henrique Martins Lima, responsável pelo caso na primeira instância. Martins Lima argumentou que a concessão unilateral do desconto, feita pelo sub-PGR Ronaldo Albo, foi um ato de “manifesta ilegalidade” e poderia ocasionar “prejuízos irreversíveis” ao cumprimento do acordo de leniência da J&F.
O próprio conselho já havia decidido, em fevereiro de 2022, que cabia a Martins Lima e não à 5ª Câmara de Coordenação e Revisão do MPF, chefiada por Albo, conduzir eventual renegociação sobre o acordo, fechado em 2017.
