O Tribunal Superior do Trabalho (TST) reconheceu o vínculo empregatício entre um entregador e a Rappi, empresa de delivery de comida.
A decisão da 6ª Turma do Tribunal é foi tomada numa ação de um entregador contra o aplicativo de entregas, mas ainda cabe recurso.
A Rappi disse que “não concorda com a decisão tomada pelo TST” e vai recorrer.
A empresa destacou que “possui decisão favorável da Justiça do Trabalho da 2ª Região pela inexistência de vínculo da plataforma com entregadores”, em uma ação civil pública movida pelo Ministério Público do Trabalho contra a Rappi.
No acórdão, divulgado no último dia 15, a relatora Kátia Magalhães Arruda afirmou existir, no caso deste entregador, os elementos que caracterizam um vínculo empregatício: “prestação de trabalho por pessoa física, com pessoalidade pelo trabalhador, não eventualidade (ou habitualidade), com subordinação e onerosidade”.
Conforme a Consolidação das Leis do Trabalho (CLT), “considera-se empregado toda pessoa física que prestar serviços de natureza não eventual a empregador, sob a dependência deste e mediante salário”.
Em uma decisão parecida, neste mês, a Justiça do Trabalho condenou a Uber a assinar as carteiras de trabalho de todos os motoristas cadastrados na plataforma no Brasil.
Como a Rappi vai recorrer, caso o Supremo Tribunal Federal (STF) também reconheça o vínculo empregatício, a empresa terá que registrar o entregador na carteira de trabalho, garantindo a ele todos os direitos previstos nas leis trabalhistas, como 13º salário, aviso prévio, férias, seguro-desemprego, entre outros, como determinou o TST. A decisão do TST é sobre um trabalhador específico, mas pode repercutir em outras ações parecidas, caso o STF acompanhe o TST.
