CPI havia quebrado sigilos fiscal, bancário e telemático sem estar ‘devidamente fundamentado, disse ministro
O ministro do Supremo Tribunal Federal (STF), Nunes Marques suspendeu a quebra dos sigilos fiscal, bancário, telefônico e telemático concedidos na CPMI do dia 8 de janeiro contra o ex-diretor-geral da Polícia Rodoviária Federal, Silvinei Vasques.
A decisão foi assinada no dia 26 do mês passado, mas só veio a público nesta terça-feira (3).
Nunes Marques destacou que o requerimento aprovado pela CPI “não está devidamente fundamentado”, “não foram especificadas as condutas a serem apuradas mediante a quebra dos sigilos bancário, fiscal e telefônico do impetrante, ou mesmo indicada a utilidade da providência”, “o pedido voltado ao fornecimento de listas com informações protegidas por segredo é amplo e genérico, podendo atingir terceiros que não são investigados”, “não há situação concreta relacionada ao impetrante que legitime a suspeita de que ele teria cometido ilícitos ligados aos eventos de 8 de janeiro último”, “a tese segundo a qual a quebra dos sigilos do autor é necessária para a CPMI ‘desvelar eventuais informações imprescindíveis para a responsabilização geral dos atos’ de 8 de janeiro, por ser embasada em premissa genérica e abstrata, não pode ser acatada”, “não se logrou externar a conexão supostamente existente entre os dados do impetrante que se pretende reunir e a investigação em curso na CPMI” e que “não há prévia definição do escopo específico para a quebra do sigilo”.
Nunes Marques afirma ainda que as informações solicitadas “que se fornecidas, representarão evidente risco de violação injustificada da privacidade, e não apenas do impetrante mas também de terceiros que nem sequer são investigados”.
