O Tribunal de Justiça do Distrito Federal e Territórios (TJDFT) anulou nesta quarta-feira (11) a condenação do ex-piloto Nelson Piquet, que em março, havia sido obrigado a pagar uma indenização por danos morais de R$ 5 milhões por falas consideradas racistas e homofóbicas contra o piloto de Fórmula 1 Lewis Hamilton.
O julgamento foi unânime.
No ano passado, o ex-piloto usou termos considerado por instituições que acionaram o judiciário, como racistas e homofóbicos ao falar, em uma entrevista, sobre Hamilton.
O processo foi movido pelas entidades Educafro, Centro Santo Dias de Direitos Humanos da Arquidiocese de São Paulo e Aliança Nacional LGBTI.
Na entrevista que gerou o processo, Nelson Piquet debochava do concorrente direto de Max Verstapen, namorado de sua filha, e disse coisas como:
“O neguinho devia estar dando mais cú naquela época, aí tava meio ruim”. Em referência ao desempenho do atleta em relação ao do genro de Piquet.
O juiz da primeira instância considerou que o ex-piloto divulgou ofensas “intoleráveis”, e ordenou que a indenização de R$ 5 milhões fosse revertida para projetos de igualdade racial e de diversidade. Em maio, a Justiça negou um recurso de Piquet.
Desta vez, o entendimento do tribunal mudou. O relator do caso, Aiston Henrique de Sousa, afirmou que Piquet fez um “deboche”, mas sem discurso de ódio.
“Não há demonstração de discurso de ódio. A utilização de termos da linguagem coloquial [informal], ainda que eivada de inspiração racista sutil ou involuntária, ainda que inadequada, não traz consigo a gravidade e a relevância suficientes para caracterizar o dano coletivo”, disse o magistrado.
O desembargador considerou também que Piquet também não fez falas homofóbicas ao dizer que Hamilton “devia estar dando mais cu naquela época”. “O deboche feito pelo réu poderia ter sido objeto também da prática sexual entre homem e mulher, de modo que não se pode extrair daí a ocorrência de discurso de ódio contra os homossexuais”, afirmou Aiston Henrique de Sousa, que foi acompanhado pelos desembargadores Fernando Habibe e Arnoldo Camanho, da 4ª Turma Cível do TJDFT.
Agora, as entidades levarão o caso ao Supremo Tribunal Federal.
