Criminoso teve soltura revogada, mas desapareceu antes de voltar a ser preso
O Conselho Nacional de Justiça (CNJ) determinou a abertura de uma reclamação disciplinar para apurar a conduta do desembargador Luiz Fernando Lima, do Tribunal de Justiça da Bahia, que mandou soltar um dos maiores traficantes do estado.
Durante um plantão judiciário no domingo, 1º, o magistrado concedeu prisão domiciliar a Ednaldo Freire Ferreira, conhecido como Dadá, líder da facção criminosa Bonde do Maluco. O episódio irritou o Ministério da Justiça.
O ministro Marco Aurélio Mello soltou o marginal em 2020, mas quando o ministro Luiz Fux revogou a prisão, André do Rap havia desaparecido e está foragido até hoje.
Um dos líderes da maior facção criminosa da América do Sul, André do Rap havia sido condenado a 15 de anos de cadeia por tráfico de 145 quilos de cocaína e estava detido desde o fim de 2019 sem uma sentença condenatória definitiva, excedendo o limite de tempo previsto na legislação brasileira.
Na versão baiana, o criminoso também desapareceu, apenas um dia depois da revogação ilegal de sua libertação.
A decisão do CNJ de iniciar a reclamação ddisciplinarcontra o magistrado baiana faz referência a um artigo publicado em um veículo de comunicação em 12 de setembro. O ministro corregedor, em sua decisão, argumentou que, com base na reportagem, aparentemente, o desembargador requerido não seguiu a devida cautela ao conceder a prisão domiciliar a um réu altamente perigoso, uma das principais lideranças de uma facção criminosa, Ednaldo Freire Ferreira, também conhecido como “Dadá”, que acabou fugindo.
Salomão também mencionou outro trecho da reportagem que destaca: “Horas depois, o pedido de prisão domiciliar foi revogado pelo desembargador Julio Travessa, da 2ª Câmara Criminal – 1ª Turma, atendendo ao recurso apresentado pelo Ministério Público da Bahia (MP-BA), através do Grupo de Atuação Especial de Combate às Organizações Criminosas e Investigações Criminais (Gaeco). No entanto, era tarde demais, Dadá já havia sido liberado do presídio de segurança máxima onde estava cumprindo a pena no Estado de Pernambuco e não foi mais encontrado.”
