A Comissão de Constituição e Justiça do Senado aprovou nesta terça-feira (7), um parecer para a proposta de emenda à Constituição (PEC) da reforma tributária.
O governo quer simplificar o sistema de hoje, considerado ineficaz e repleto de distorções, o que acaba encarecendo o valor dos itens para o consumidor final, mas a proposta sofre críticas, como as contra a taxação de heranças.
Tributação progressiva sobre heranças
O texto também estabelece uma cobrança progressiva do ITCMD (Imposto de Transmissão Causa Mortis e Doação), em razão do valor da herança ou da doação.
A cobrança será feita no domicílio da pessoa falecida. A medida tem o objetivo de impedir que os herdeiros busquem locais com tributações menores para processar o inventário.
A proposta também cria regra que permite cobrança sobre heranças no exterior.
O parecer do senador Eduardo Braga prevê que o ITCMD não será cobrado sobre doações para instituições sem fins lucrativos “com finalidade de relevância pública e social, inclusive as organizações assistenciais e beneficentes de entidades religiosas e institutos científicos e tecnológicos”.
Um dos principais pontos da reforma é substituir cinco impostos hoje existentes por apenas um.
Para isso, haverá uma fase de transição, que buscará evitar perdas de arrecadação por parte de estados ou municípios.
Alguns produtos terão alíquota mais baixa do imposto único; outros ainda terão isenção.
A reforma prevê criar IPVA para lanchas e jatinhos, além de taxar heranças.
Templos religiosos seguirão isentos de cobranças de impostos.
Segundo a proposta, o período de transição para unificação dos tributos vai durar sete anos, entre 2026 e 2032. A partir de 2033, os impostos atuais serão extintos. A transição foi prevista para não haver prejuízo de arrecadação para nenhum estado ou município.
