Tribunal de Justiça do Rio derrubou a medida liminar que também proibia a condução de crianças e adolescentes ‘para simples verificação da existência de mandado de busca e apreensão
O desembargador Ricardo Rodrigues Cardozo, presidente do Tribunal de Justiça do Rio de Janeiro (TJRJ), revogou neste sábado (16) a decisão que proibia a apreensão de menores sem ser em casos de flagrante nas praias do Rio.
A medida derrubou a decisão da juíza Lysia Maria da Rocha Mesquita, da 1ª Vara da Infância, da Juventude e do Idoso da Capital, que determinava que o governo do estado e a Prefeitura do Rio se abstivessem de “apreender e conduzir adolescentes a instituições de acolhimento, senão em hipótese de flagrante de ato infracional, ou por ordem escrita e fundamentada de autoridade judiciária, entre outras proibições.”
A decisão também derrubou a medida que proibia a condução de crianças e adolescentes “para simples verificação da existência de mandado de busca e apreensão.”
O presidente do TJRJ atendeu ao pedido do Estado e do Município, que recorreram da decisão na sexta-feira (15).
O desembargador destacou que a liminar da 1ª Vara da Infância foi concedida sem que tenham sido ouvidos, previamente, o Estado e o Município do Rio de Janeiro, responsáveis pela “Operação Verão”.
Na opinião do presidente do TJRJ, “tal interferência judicial, implementada, tem o condão de subtrair das autoridades competentes, em âmbito estadual e municipal, a avaliação acerca da configuração de situação de vulnerabilidade ou risco social”, destacou Ricardo Cardozo.
O desembargador também considerou que os casos de encaminhamento de adolescentes abordados à instituição de acolhimento não violam seu direito de ir e vir.
A Operação Verão, uma parceria da prefeitura e do governo do estado, começou em setembro. Desde então, o policiamento está reforçado, e suspeitos são abordados e levados para a delegacia mais próxima para averiguação.
As ações, no entanto, não impediram arrastões, como o do início do mês, em que um empresário acabou desacordado e roubado com o efeito de um soco.
