Dez adolescentes morreram após fogo tomar conta de alojamento no centro de treinamento do Flamengo, em 2019
A Justiça do Rio de Janeiro decidiu absolver todos os réus do caso do incêndio no Ninho do Urubu, que matou dez jovens atletas das categorias de base do Flamengo em fevereiro de 2019.
A sentença, assinada pelo juiz Tiago Fernandes de Barros, da 36ª Vara Criminal da Comarca da Capital, foi publicada na terça-feira, 21 de outubro de 2025, e absolve sete acusados que ainda respondiam ao processo em primeira instância.
A tragédia e as investigaçõesO incêndio ocorreu na madrugada de 8 de fevereiro de 2019, nas instalações provisórias do Centro de Treinamento George Helal, conhecido como Ninho do Urubu.
Dez adolescentes, com idades entre 14 e 16 anos, morreram enquanto dormiam em contêineres adaptados como alojamento. Três outros jovens ficaram feridos.
As investigações apontaram que o fogo teve início em um ar-condicionado com problemas elétricos, e o material inflamável das estruturas contribuiu para a rápida propagação das chamas.
Na época, o CT não possuía alvará de funcionamento emitido pela Prefeitura do Rio.
A decisão judicialA sentença do juiz Tiago Fernandes de Barros fundamentou-se na “ausência de demonstração de culpa penalmente relevante” e na “impossibilidade de estabelecer um nexo causal seguro entre as condutas individuais dos réus e a origem do incêndio” .
Segundo o magistrado, as provas apresentadas pela Polícia Civil e pelo Ministério Público não foram suficientes para comprovar responsabilidades diretas ou negligência penal. Outro ponto destacado foi que nenhum dos acusados tinha funções relacionadas à manutenção elétrica ou à segurança dos módulos que serviam como dormitórios.
Quem foram os absolvidos
Os sete réus foram:
-Márcio Garotti, ex-diretor financeiro do Flamengo
-Marcelo Maia de Sá, ex-diretor adjunto de patrimônio do clube
-Danilo Duarte, engenheiro responsável pela NHJ, empresa dos contêineres
-Fabio Hilário da Silva, engenheiro eletricista da NHJ
-Weslley Gimenes, engenheiro civil da NHJClaudia Pereira Rodrigues, responsável pelos contratos da NHJ
-Edson Colman, sócio da Colman Refrigeração, empresa responsável pela manutenção dos aparelhos de ar-condicionado.
Outras quatro pessoas já haviam sido absolvidas em decisões anteriores, entre elas o ex-presidente do Flamengo Eduardo Bandeira de Mello, além de outros dois ex-diretores e um monitor das categorias de base.
O Ministério Público do Estado do Rio de Janeiro (MPRJ), que havia pedido a condenação de todos os acusados, ainda pode recorrer da decisão. O órgão sustentava que houve negligência do clube e de prestadores de serviço na estrutura e operação dos alojamentos.
O caso, um dos mais emblemáticos da história recente do esporte brasileiro, gerou grande comoção pública e resultou em mudanças nas normas de segurança e fiscalização de centros de treinamento em todo o país.
A decisão põe fim à etapa criminal em primeira instância de um processo que se arrastava desde 2021. O juiz também ressaltou que a denúncia do MPRJ foi “abrangente e genérica”, sem individualizar as condutas de cada acusado.
Advogados de defesa comemoraram a decisão, afirmando que seus clientes foram injustamente apontados sem provas concretas. Já familiares das vítimas manifestaram indignação e prometeram recorrer por meio de assistentes de acusação.
A tragédia do Ninho do Urubu completou seis anos em 2025 e permanece como um marco doloroso na história do futebol brasileiro, agora reacendido pela controvérsia judicial sobre a ausência de condenações.
