São 190 mandados de busca e apreensão contra pessoas ligadas ao Grupo Refit, apontado como o maior devedor de ICMS de São Paulo
A Refit, empresa do setor de combustíveis é alvo de uma operação realizada por uma força-tarefa contra sonegação na manhã desta quinta-feira (27). O esquema investigado teria causado prejuízo de R$ 26 bilhões aos cofres estaduais e federal.
O Grupo Refit, comandado pelo empresário Ricardo Magro, é considerado o maior devedor de ICMS (Imposto sobre Circulação de Mercadorias ou Serviços) do estado de São Paulo, o segundo maior do Rio e um dos maiores da União. Procurada, a defesa do grupo não havia se manifestado até a última atualização desta reportagem.
Os alvos da operação são ligados ao Grupo Refit, dono da Refinaria Manguinhos, no Rio de Janeiro, e de outras empresas do setor de combustíveis.
Por meio de complexas operações financeiras, o grupo movimentou mais de R$ 70 bilhões em apenas um ano, utilizando empresas próprias, fundos de investimento e offshores – incluindo uma exportadora fora do Brasil – para ocultar e blindar lucros. Suas operações financeiras são administradas pelo próprio grupo, que controla empresas financeiras e utiliza estruturas internacionais para blindagem patrimonial.
Em setembro, a Receita e Agência Nacional do Petróleo interditaram a Refit e apreenderam navios carregados de combustível importado irregularmente da Rússia.
As fraudes ocorriam por meio de uma rede de colaboradores, holdings, offshores, meios de pagamento e fundos de investimento.
O dinheiro ilícito era reinvestido em negócios, propriedades e outros ativos por meio de fundos de investimento, dando aparência de legalidade e dificultando o rastreamento.
A Receita Federal já identificou 17 fundos ligados ao grupo, que somam patrimônio líquido de R$ 8 bilhões. Em sua maioria, são fundos fechados com um único cotista, geralmente outro fundo, criando camadas de ocultação. Há indícios de que as administradoras colaboraram com o esquema, omitindo informações à Receita.
A análise dos fundos identificou a participação de entidades estrangeiras como sócias e cotistas, além da coincidência de representantes legais entre offshores e fundos.
Essas entidades foram constituídas em Delaware, nos Estados Unidos, jurisdição conhecida por permitir a criação de empresas do tipo LLC com anonimato e sem tributação local, desde que não gerem renda em território norte-americano.
Por meio dessa estrutura, as entidades deixam de ser tributadas tanto nos EUA quanto em território nacional. Tal prática é comumente associada a estratégias voltadas à lavagem de dinheiro ou blindagem patrimonial dos envolvidos.
Segundo as investigações, importadoras atuavam como interpostas pessoas, adquirindo do exterior nafta, hidrocarbonetos e diesel com recursos provenientes de formuladoras e distribuidoras vinculadas ao grupo. Apenas entre 2020 e 2025, foram importados mais de R$ 32 bilhões em combustíveis pelos investigados.
Uma das principais operações internacionais envolveu a aquisição de uma exportadora em Houston, Texas, da qual foram importados combustíveis no valor de mais de R$ 12,5 bilhões entre 2020 e 2025.
Já foram identificadas mais de 15 offshores nos EUA, que remetem recursos para aquisição de participações e imóveis no Brasil, totalizando cerca de R$ 1 bilhão.
Também foram detectados envios ao exterior superiores a R$ 1,2 bilhão sob a forma de contratos de mútuo conversíveis em ações, que podem retornar ao Brasil como investimentos por meio de outras offshores.
Os mandados da operação batizada como Poço de Lobato são cumpridos em cinco estados — São Paulo, Rio de Janeiro, Minas Gerais, Bahia, Maranhão — e no Distrito Federal.
A Operação Poço de Lobato foi deflagrada pelo Comitê Interinstitucional de Recuperação de Ativos do Estado de São Paulo (Cira-SP) e conta com a participação da Receita Federal, Ministério Público de São Paulo, Secretaria da Fazenda e Planejamento do Estado de SP, Secretaria Municipal de Fazenda de SP, Procuradoria-Geral da Fazenda Nacional, Procuradoria-Geral do Estado de SP e polícias Civil e Militar.
