Alexandre de Moraes contradiz Flávio Dino e afirma que não há impedimento para CPI ter imagens internas do Ministério da Justiça
O ministro do Supremo Tribunal Federal (STf) Alexandre de Moraes autorizou o Ministério da Justiça e Segurança Pública a compartilhar as imagens do 8 de Janeiro com a Comissão Parlamentar Mista de Inquérito (CPMI) que investiga os atos antidemocráticos. A autorização abrange a liberação das imagens tanto dos circuitos interno e externo de segurança do Palácio da Justiça.
“O acesso às informações consubstancia-se em verdadeira garantia instrumental ao pleno exercício do princípio democrático, que abrange ‘debater assuntos públicos de forma irrestrita, robusta e aberta’ (Cantwell v. Connecticut, 310, U.S. 296, 310 (1940(, quoted 376 U.S. At 271-72), de maneira a garantir a necessária fiscalização dos órgãos governamentais, que somente se torna efetivamente possível com a garantia de publicidade e transparência”, diz trecho da decisão do ministro do STF.
Moraes argumentou que não há qualquer excepcionalidade que impeça a cessão e compartilhamento de imagens à CPMI, que deverá analisar se torna públicas ou mantém o sigilo das gravações em virtude das investigações em andamento.
