Infrações sanitárias cometidas durante a pandemia podem ser canceladas porque tinham caráter educativo e não arrecadatório
O governador de São Paulo, Tarcísio de Freitas (Republicanos), enviou para a Assembleia Legislativa de São Paulo (Alesp) um projeto de Lei que pretende cancelar as multas sanitárias aplicadas durante a pandemia da Covid-19.
No período da pandemia, foram aplicadas 10.163 autuações de estabelecimentos comerciais e festas clandestinas e feitas 579 autuações de pessoas, que, por exemplo, andavam nas ruas sem máscaras. Participaram da fiscalização 135 municípios do Estado de São Paulo. As multas totalizaram R$ 72 milhões.
No texto, o governador argumenta que a Secretaria da Saúde promoveu ações de fiscalização e autuações com intuito de evitar a disseminação do vírus e a consequente exaustão do serviço de saúde. Diz também que as multas tinham a intenção de promover a conscientização como estímulo para a prevenção da propagação do agente patológico, e não intuito arrecadatório.
“Nesse contexto, a manutenção das penalidades aplicadas em decorrência de obrigações impostas para a prevenção e enfrentamento da pandemia de COVID-19 não mais condiz com o fim dos estados emergenciais de saúde pública e acaba por sobrecarregar a administração com o gerenciamento de processos administrativos e de cobranças de multas sem finalidade arrecadatória“, explica o governo no texto enviado ao presidente da Alesp.
De acordo com o documento, as multas que já foram pagas não serão ressarcidas. Tarcísio também foi multado por não usar máscara em público e, segundo ele, suas multas já foram quitadas.
Para o governador, a manutenção das multas sobrecarrega a administração, pois é custoso processar milhares de débitos.
Um dos potenciais beneficiados pelo projeto de Lei é o ex-presidente Jair Bolsonaro. Durante motociatas pelo interior do Estado, ele foi multado três vezes por descumprir medidas sanitárias. As multas de Bolsonaro somam mais de R$ 43 mil.
No ano passado, a defesa do ex-presidente pediu ao Tribunal de Justiça de São Paulo (TJ-SP) a suspensão das multas aplicadas por ele não usar máscara durante as motociatas. O juiz Carlos Eduardo D’Elia Salvatori, da 4ª Vara do Juizado Especial da Fazenda Pública da Capital, não acolheu a argumentação.
“Solicitar apoio policial, diante de todo o contexto, poderia causar maior tumulto. Por evidência, não pode ser desconsiderado que a parte autora, pelo mandato que exerce, objetivamente impõe contornos especiais à situação”, afirmou Salvatori.
