Conselheiro federal da OAB protocolou pedido de desagravo em favor do advogado de Filipe Martins, Jeffrey Chiquini
O conselheiro federal da Ordem dos Advogados do Brasil (OAB) Marcelo Tostes ingressou com uma representação para que a entidade se manifeste contra medidas adotadas pelo ministro do Supremo Tribunal Federal (STF) Alexandre de Moraes.
O pedido de desagravo foi protocolado em sessão do Conselho Federal da OAB nesta segunda-feira (20/10), em favor do advogado Jeffrey Chiquini, destituído por Moraes da defesa de Filipe Martins, ex-assessor de Jair Bolsonaro denunciado por tentativa de golpe de Estado.
“Estou protocolando aqui no Conselho Federal esse desagravo público, em favor do advogado Jeffrey Chiquini, não só por ter sido indevidamente destituído, mas também por representar todos os advogados que atuaram e atuam naquele caso fatídico do inexistente golpe de 8 de janeiro”, disse Tostes durante a sessão.
Na representação, a atitude de Moraes é apontada como “grave violação às prerrogativas profissionais da advocacia, especialmente ao direito à inviolabilidade do exercício profissional”.
“Quando um magistrado, sobretudo integrante da Suprema Corte, interfere na relação entre cliente e advogado, sem qualquer fundamento legal, estabelece-se um perigoso precedente de autoritarismo, que intimida e fragiliza toda a classe”, diz o documento. O presidente da OAB, Beto Simonetti, tem 15 dias para decidir sobre a publicação do desagravo.
Chiquini foi destituído por Moraes após questionar a apresentação, pela Procuradoria-Geral da República (PGR), de elementos supostamente relevantes ao processo após a instrução da ação penal sobre a tentativa de golpe de Estado e, com base nisso, solicitar novo prazo para elaboração da defesa. Moraes suspendeu o afastamento após recurso apresentado pelo advogado.
