O caso
Membros do MP que atuavam na Lava jato denunciaram os senadores do MDB Romero Jucá, Edison Lobão e seu filho, Márcio Lobão, em março de 2016, por supostos crimes na construção da Usina Angra 3. À época, havia medidas cautelares sigilosas em andamento, mas nãoeram determinadas por juízo. Um dia depois, o site do MPF noticiou o oferecimento e detalhes das denúncias. A Justiça Federal no Rio determinou o sigilo dos processos poucos dias mais tarde.
Em junho de 2021, a Corregedoria Nacional do Ministério Público propôs a abertura de processo administrativo disciplinar (PAD) contra os acusados, mesmo nãohavendo na data da publicação, determinação judicial de sigilono processo. Mas, segundo o órgão, os lavajatistas descumpriram o seu dever de sigilo ao fornecer os dados das denúncias à assessoria de imprensa do MPF.
A defesa dos denunciados, feita pelo advogado Fabio Medina Osório, argumentou que seria outra investigação dos então senadores que estava sob sigilo desde 2017. Já a defesa dos procuradores no processo, a cargo do advogado Saul Tourinho Leal, alegou que a juíza do caso afirmou não haver decretação de sigilo.
O PAD foi aberto em 19 de outubro de 2021, com oito votos no Plenário do CNMP.
