A Polícia Federal informou ao Supremo Tribunal Federal que encerrou as investigações do inquérito aberto para apurar a conduta do presidente Jair Bolsonaro ao associar, falsamente, as vacinas contra a Covid a um risco maior de contrair o vírus da Aids.
O inquérito já havia concluído que Bolsonaro cometeu incitação ao crime ao divulgar essas informações falsas – e, com isso, desestimular o uso de máscaras e a vacinação contra Covid no país.
A relação que o presidente fez não corresponde à verdade. A Agência Nacional de Vigilância Sanitária (Anvisa) e outras autoridades de saúde já esclareceram que as vacinas não trazem doenças. Pelo contrário, evitam contaminação.
Na mesma transmissão pela internet, Bolsonaro divulgou outra mentira: a de que pessoas teriam morrido de pneumonia, durante a epidemia de gripe espanhola na Europa, por terem usado máscaras. Não há dados históricos que comprovem essa afirmação.
Agora, com a conclusão das investigações, o material será remetido ao STF.

A declaração mentirosa
Bolsonaro fez a associação falaciosa entre vacina da Covid e risco de desenvolver Aids em uma live nas redes sociais no dia 21 de outubro do ano passado.
Em agosto, a delegada Lorena Lima Nascimento afirmou ao STF ter elementos de que Bolsonaro e o ajudante de ordens Mauro Cid, que ajudou o presidente produzir o material divulgado na live, cometeram incitação ao crime.
No Código Penal, incitação ao crime é conduta ilegal que pode dar prisão de três a seis meses.
A PF vê ainda que houve uma contravenção penal dos dois por provocarem alarme , “anunciando desastre ou perigo inexistente, ou praticar qualquer ato capaz de produzir pânico ou tumulto”.
“Jair Messias Bolsonaro teria, de forma direta, voluntaria e consciente disseminado a desinformação de que as vítimas da gripe espanhola, na verdade teriam morrido em decorrência de pneumonia bacteriana, “causada pelo uso de máscara”, incutindo na mente dos expectadores um verdadeiro desestímulo ao seu uso no combate à COVID-19, quando naquele momento, por determinação legal, seu uso era obrigatório pela população, contrariando as orientações mundiais atinentes ao combate à pandemia da COVID-19 promovidas pela Organização Mundial de Saúde, à utilização de vacinas no enfretamento da COVID-19, bem como às normas legislativas vigentes à época”, escreveu a delegada.
A delegada cita que Bolsonaro foi intimado para marcar depoimento, mas como não houve resposta a PF considerou que era o exercício do direito de permanecer em silêncio.
“Essa ausência, contudo, não trouxe qualquer prejuízo à elucidação dos fatos”, diz.
“Pelas razões acima expostas, finalizamos a presente investigação criminal concluindo-se pela existência de elementos probatórios concretos suficientes de autoria e materialidade para se atestar que JAIR MESSIAS BOLSONARO e MAURO CESAR BARBOSA CID, em concurso de pessoas, em concurso de pessoas, cometeram os delitos de ‘provocar alarma, anunciando desastre ou perigo inexistente, ou praticar qualquer ato capaz de produzir pânico ou tumulto’, previsto do art. 41 da Lei de Contravenções Penais, bem como de ‘incitação ao crime’, previsto no art. 286 do Código Penal Brasileiro”.
