Decreto publicado na sexta-feira tem efeito imediato
O presidente em exercício, Hamilton Mourão, editou um decreto que reduz as alíquotas do PIS/Pasep e da Cofins sobre uma série de operações financeiras.
O decreto foi publicado na noite de sexta-feira (30) em edição extra do Diário Oficial da União. A medida tem efeito imediato.
A Cofins foi reduzidapela metade, a alíquota caiu de 4% para 2%. No caso do PIS/Pasep, a alíquota caiu de 0,65% para 0,33%.
Serão impactadas pelas mudanças receitas financeiras “decorrentes de operações realizadas para fins de hedge, auferidas pelas pessoas jurídicas sujeitas ao regime de apuração não-cumulativa das referidas contribuições”, diz comunicado da Secretaria-Geral da Presidência da República divulgado neste sábado (31).
A IN RFB 1.911/2019 dizia que as receitas financeiras deveriam ser tributadas com a aplicação das “alíquotas da Contribuição para o PIS/Pasep e da Cofins de, respectivamente, 0,65% (sessenta e cinco centésimos por cento) e 4% (quatro por cento)”, porém, nas empresas que estão no regime de apuração não cumulativa, estão sujeitas à alíquota 0 (zero) as receitas financeiras decorrentes de operações de cobertura (hedge) realizadas em bolsa ou no mercado de balcão organizado, destinadas exclusivamente à proteção contra riscos inerentes às oscilações de preço ou de taxas quando, cumulativamente, o objeto do contrato negociado:
- a) estiver relacionado com as atividades operacionais da pessoa jurídica; e
- b) destinar-se à proteção de direitos ou obrigações da pessoa jurídica.
