A Polícia Federal deflagrou, na manhã desta segunda-feira (24), com apoio do Ministério Público Federal (MPF), por meio do Grupo de Atuação Especial de Combate ao Crime Organizado (Gaeco) e da Controladoria-Geral da União (CGU), a Operação Pares do Rei. O objetivo da ação é aprofundar as investigações dos crimes relacionados à execução de obras rodoviárias no norte de Minas Gerais, que causaram prejuízo ao erário e à população usuária das estradas da região.
O nome da operação relaciona-se ao fato de se apurar, nesta fase, o envolvimento de pessoas físicas e empresas que participavam do esquema possivelmente auxiliando um fiscal de obras do Dnit.
Dezesseis policiais federais cumprem cinco mandados de busca e apreensão nos municípios de Guaratinguetá (SP), Botumirim (MG) e Montes Claros (MG), além do afastamento do sigilo fiscal de 22 investigados e do sigilo bancário de 23 pessoas físicas e jurídicas.
Os envolvidos poderão responder pelos crimes de peculato, corrupção, fraude à licitação, falsidade ideológica, organização criminosa e lavagem de dinheiro, cujas penas máximas somadas chegam a 51 anos de prisão.
A Operação BR-090, iniciada em agosto de 2019, vem desarticulando organizações criminosas que agem dentro do Dnit em Minas Gerais com o objetivo de desviar recursos das obras executadas pelo órgão. Foram identificados indícios de fraude ao caráter competitivo dos processos licitatórios, recebimento de vantagens indevidas, superfaturamento em obras públicas e execução de serviços de baixa qualidade.
Até o momento, no decorrer das oito fases da Operação BR-090, foram verificados contratos de obras rodoviárias que perfazem um total de quase R$ 2 bilhões. Três inquéritos, decorrentes das referidas fases, foram relatados pela Polícia Federal, com respectivas denúncias pelo Ministério Público Federal, por meio do Grupo de Atuação Especial de Combate ao Crime Organizado (Gaeco).
Quatro empresas foram punidas por meio de processo administrativo de responsabilização e três servidores demitidos em função de processos administrativos disciplinares conduzidos pela Controladoria-Geral da União.
A PF ressaltou que ainda estão sendo concluídos os levantamentos dos valores de recursos públicos desviados no decorrer das apurações na Operação BR-090. No entanto, contabilizando o que já foi apurado até o momento e considerando o custo médio gerencial de manutenção estimado pelo Dnit, verificou-se que, com o montante desviado, seria possível a realização da manutenção de aproximadamente 2.100 km de rodovia por um ano.
A fase Rei do Norte, deflagrada em agosto de 2021, teve como foco principal a atuação da organização criminosa com ação na região de Montes Claros. O exame técnico do material apreendido está ocorrendo por meio de análise pericial de material extraído de algumas rodovias numa atuação articulada entre o Setor Técnico Científico da Superintendência da Polícia Federal em Minas Gerais, a Diretoria Técnico-Científica (DITEC) da Polícia Federal e a Controladoria-Geral da União.
No âmbito da investigação dessa última fase, foram verificados indícios de pagamento indevido de vantagens e favorecimento de servidores a uma das empresas contratadas.
