Família de uma mulher de 35 anos denunciou o caso. Profissional nega irregularidade.
O cirurgião plástico equatoriano Bolívar Guerrero Silva, de 63 anos, foi preso ontem pela Polícia Civil do Rio sob a acusação de manter uma paciente em cárcere privado dentro de um hospital particular em Duque de Caxias, na Baixada Fluminense. A vítima diz que estava sendo mantida contra a vontade no local nos últimos dois meses, o que é negado pelo médico e pelo Hospital Santa
Branca.
Segundo a família da paciente, ela se submeteu a uma abdominoplastia (uma plástica no abdômen) em março com o cirurgião. Alguns dias depois da cirurgia, com dores, a mulher voltou a procurar o médico.
Desde então, ela já teria sido
submetida a vários outros procedimentos.
Após a denúncia, a polícia requisitou à clínica o prontuário médico da paciente e não foi atendida. Na última sexta-feira, policiais estiveram no hospital e enfrentaram dificuldades para ter acesso à paciente.
Quando conseguiram vê-la, constataram as péssimas condições de saúde da mulher, de
35 anos.
“Ela relatou dificuldades, que não estava conseguindo sair do hospital. Por conta disso, representamos no Plantão Judiciário pela transferência dela, prisão temporária do autor e suspensão do CRM (registro do profissional médico que confere legalidade à atuação)”, disse a delegada Fernanda Fernandes.
A policial afirmou que a barriga da paciente estaria necrosada. No último sábado, a Justiça decretou a prisão do médico e a suspensão temporária de seu registro profissional. Também expediu mandados de condução coercitiva de quatro funcionários do hospital, além de mandados de busca e apreensão de documentos, como prontuários e lista de medicamentos utilizados no tratamento.
Em nota, o Hospital Santa Branca negou as acusações de cárcere privado. “Repudiamos quaisquer práticas criminosas que nos foram indevidamente atribuídas! Tal acusação é absurda!” A nota esclarece ainda que o médico não seria sócio do hospital, como a polícia informou, e que arcou pessoalmente com as despesas da paciente.
A advogada Louisiana dos Santos Juliasse de Barros, que defende o médico, disse que não daria entrevistas. Bolívar Guerrrero Silva já
teria sido preso outras cinco vezes, de acordo com informações preliminares que não foram esclarecidas pela polícia.
Na página do médico no Facebook, mulheres alertam para o risco de se submeter a cirurgias plásticas com ele. Em outra rede social, funcionários tentavam angariar apoio ao médico, com relatos de procedimentos bem sucedidos.
O profissional prestou depoimento na tarde desta segunda. À polícia, ele negou que estivesse mantendo a mulher em
cárcere privado. Segundo ele, a alta médica não era recomendada no caso dela e só poderia ser feita à revelia, ou seja, quando o paciente assina um termo de responsabilidade, o que a paciente não teria feito.
Até o fim da tarde, ela não tinha sido
transferida. Na tarde de ontem, pelo menos quatro mulheres se apresentaram à Deam para prestar queixa do médico. O Conselho Regional de Medicina do Rio de Janeiro (Cremerj) soltou uma curta nota no fim da tarde de ontem sobre o caso: “Tendo conhecimento do caso pela imprensa, o Cremerj abriu sindicância para apurar os fatos. Todo procedimento segue em sigilo de acordo com os ritos do Código de Processo Ético-Profissional”.
