Nesta segunda-feira (7), a Procuradoria-Geral da República (PGR) pediu ao Supremo Tribunal Federal (STF) as primeiras condenações de réus dos atos de vandalismo do 8 de janeiro.
Neste primeiro bloco, a PGR defende a condenação de 40 réus por crimes como associação criminosa armada, abolição violenta do Estado Democrático de Direito, dano qualificado pela violência e grave ameaça, com emprego de substância inflamável, contra o patrimônio da União e com considerável prejuízo para a vítima. Somadas, as penas podem chegar a 30 anos de prisão.
Nas alegações finais, a PGR sustenta que houve uma estruturação preliminar dos atos golpistas antes do dia 8 de janeiro, sendo que havia um propósito deliberado de tomada do poder.
“A forma como agiram os invasores demonstrou, de um lado, a estruturação do grupo criminoso e, de outro, a fragilidade da contenção imposta pela PMDF, notadamente em razão da ausência do efetivo policial necessário para impedir o avanço da turba”.
O STF já abriu processos penais contra 1.290 acusados de participação nos atos de depredação de sedes dos Três Poderes, em Brasília. Desde abril, as denúncias, divididas em oito blocos, foram apresentadas ao Supremo. Em todos os casos julgados, até agora, o STF decidiu por maioria, tornar réus os denunciados.
Segundo dados da Corte, 253 pessoas ainda continuam presas pelos ataques aos prédios do Congresso, Planalto e do Supremo. Cem denúncias ainda precisam ser julgadas.
A perspectiva dentro do tribunal é de que as primeiras ações já estejam aptas para julgamento no segundo semestre. O STF vai, então, decidir se os réus serão condenados ou absolvidos pelos atos.
