São 6 votos a 1 pela implementação, mas ministros divergem sobre prazo e limite de atuação
O Supremo Tribunal Federal (STF) formou maioria de votos nesta quinta-feira (17) para tornar obrigatória a implementação da figura do juiz das garantias pelas instâncias inferiores da Justiça.
Após nove sessões, o julgamento voltou a ser paralisado após o voto do ministro Edson Fachin, que consolidou o placar de 6 votos a 1 para obrigar a adoção do mecanismo. A análise será retomada na próxima semana.
Embora tenham definido que a adoção do mecanismo será obrigatória, os ministros ainda discutem uma espécie de prazo de transição para implementar o mecanismo em todo país. Nos votos, foram propostos 12, 18 e 36 meses para a adoção do instrumento.
O juiz das garantias foi instituído pelo pacote anticrime, aprovado pelo Congresso em 2019. Um ano depois, a implementação, no entanto, foi suspensa por decisão do ministro Luiz Fux.
Essa figura é representada por um magistrado que acompanha e verifica a legalidade das medidas tomadas pela polícia e o Ministério Público ao longo das investigações.
Estão em discussão temas como as regras do arquivamento de inquéritos, atribuições do juiz das garantias, formato de realização de videoconferências e procedimentos para prisões em flagrante.
Quando o caso é enviado à Justiça, esse juiz dá lugar a um novo magistrado, que atua no julgamento propriamente dito.
Até esta quinta, 7 ministros da Corte se posicionaram:
- contra a obrigatoriedade: o relator, ministro Luiz Fux
- a favor da obrigatoriedade: ministros Dias Toffoli, Cristiano Zanin, André Mendonça, Alexandre de Moraes, Nunes Marques e Edson Fachin
Ainda restam os votos dos ministros Luís Roberto Barroso, Cármen Lúcia, Gilmar Mendes e Rosa Weber.
No julgamento, os ministros também validaram trechos questionados do acordo de não-persecução penal, que impede o investigado de ser levado a julgamento e ir à prisão.
Pelo mecanismo, antes da denúncia, o Ministério Público pode oferecer ao investigado um acordo no qual ele confessa o crime.
O chamado ANPP é aplicado nas situações em que o crime é cometido sem violência ou grave ameaça e tem pena mínima inferior a 4 anos.
Ao selar o acordo, o investigado se compromete a reparar o dano cometido. Em troca, o MP pode determinar prestação de serviços à comunidade, pagamento de multa, ou ainda outra condição.
O instrumento havia sido incluído na lei do juiz das garantias pelo pacote anticrime. Antes, o instrumento era regulamentado por uma resolução do Conselho Nacional do Ministério Público (CNMP).
Entre os pontos questionados, estavam as possíveis condições a serem impostas pelo MP ao investigado — como prestação de serviços à comunidade e pagamento de multa.
