O mesmo tribunal que soltou e anulou as condenações por roubo de bilhões do dinheiro público, do atual presidente da República Luiz Inácio Lula da Silva (PT), decidiu nesta sexta-feira (27), manter preso um jovem que furtou uma lata de leite em pó e três lenços umidecidos.
O Supremo Tribunal Federal (STF) negou um pedido de habeas corpus ao homem de 28 anos acusado de furtar os ítens avaliados em R$ 62.
Os itens foram furtados em fevereiro de 2021, de uma unidade da farmácia Preço Popular em Concórdia, Santa Catarina.
A Defensoria Pública da União (DPU) apelou ao Supremo para que fosse aplicado o princípio da insignificância.
O julgamento foi finalizado no plenário virtual do STF nesta sexta-feira, 27.
Em sua decisão, André Mendonça, o relator do caso, alegou que o acusado era recorrente no crime de furto. “Surge revelada considerável reprovabilidade da conduta, de modo a inviabilizar, por ora, o reconhecimento da incidência do princípio da insignificância”, escreveu o ministro.
O defensor público que atua no Supremo, Gustavo Ribeiro, comentou: “Acreditar que a condenação dos milhões de miseráveis que ocupam as ruas do Brasil — e que crescem a olhos vistos, diga-se — servirá como desestímulo ao furto famélico é ignorar a necessidade que se coloca por trás da subtração de alimentos, sabonetes e pares de chinelo. Ninguém subtrai essas coisas por escolha, e a resposta penal apenas agrava a situação”.
Em 2021, indo contra um recurso da Procuradoria-Geral da República (PGR) o STF anulou todas as condenações de Lula proferidas pelo ex-juiz e agora senador, Sérgio Moro e pela juíza Gabriela Hardt.
O STF alegou que 13ª Vara Federal em Curitiba não tinha competência legal para julgar as acusações. Com a decisão, o ex-presidente não tem mais restrições na Justiça Eleitoral e está novamente em cargo público.
Pela decisão, ficaram anuladas as condenações de Lula nos casos do triplex do Guarujá (SP), com pena de 8 anos e 10 meses de prisão, e do sítio em Atibaia, na qual o ex-presidente recebeu pena de 17 anos de prisão e demais processos que ainda estavam em curso.
