A Procuradoria-Geral da República (PGR) pediu nesta segunda-feira, 30, que o ministro Dias Toffoli, do Supremo Tribunal Federal (STF), relator da ação sobre uma suposta agressão que teria sido sofrida pelo ministro Alexandre de Moraes também do STF e sua família, reveja parte da decisão. No dia 24 de outubro, o ministro Toffoli autorizou o ministro Moraes, a esposa e os três filhos a se tornarem assistentes de acusação no processo, gerando conflito de interesses.
A Procuradora-Geral da República interina, Elizeta Ramos pede que o Ministério Público tenha cópia integral dos autos, como, por exemplo, a íntegra dos vídeos de câmeras de vigilância no aeroporto de Fiumicino, o aeroporto italiano onde ocorreu o caso de suposta agressão em julho.
“Como se percebe, os óbices impostos pela decisão fustigada limitam desarrazoadamente e inconstitucionalmente o acesso à prova ao Ministério Público“, argumentou Elizeta à Suprema Corte. “As limitações impostas no acesso e manuseio do elemento probatório, na prática, tendem a inviabilizar a execução dessas atividades, sendo imperioso, ao menos, que se possibilite ao Ministério Público a extração de cópia a partir do material bruto, sem qualquer edição ou manipulação, em que seja possível confrontar original e cópia e averiguar a cadeia de custódia”
Moraes estava com sua família vindo de Siena, onde deu uma palestra na universidade local. No terminal aeroportuário, no entanto, ele teria sido abordado por três brasileiros que, segundo o ministro, aos gritos de “bandido, comunista e aloprado”. Moraes reclama no processo, que seu filho foi fisicamente agredido na discussão.
