Presos com acusação generalizada e sem individualização de delitos sofrem punição fora de padrões da justiça
O ministro do Supremo Tribunal Federal (STF) Alexandre de Moraes soltou nesta sexta-feira (24) um morador de rua preso há quase um ano por ser acusado de tentar dar im Golpe de Estado e abolir violentamente o Estado de Direito, segundo o STF.
Durante a investigação, porém, testemunhas afirmaram que o acusado não cometeu os crimes pelos quais foi denunciado. Mesmo assim foi mantido ilegalmente preso pelo STF por dez meses.
Moraes revogou a prisão de Geraldo Filipe da Silva, que continua réu, porém respondendo aos crimes que lhe são imputados pela Suprema Corte, em liberdade.
Geraldo é o oitavo réu solto após a morte de outro preso no dia 8 de janeiro, Cleriston Pereira da Cunha no Complexo Penitenciário da Papuda, em Brasília.
A Procuradoria-Geral da República informou ao STF que Geraldo Filipe da Silva, réu do 8 de janeiro, era apenas um morador de rua, e que inclusive apanhou de manifestantes violentos que participaram dos atos de vandalismo nas sedes dos Três Poderes.
A informação consta no pedido de absolvição feito pela PGR ao ministro Alexandre de Moraes, em 7 de novembro.
Segundo o subprocurador da República, Carlos Frederico Santos, não há provas para condenar Geraldo da Silva.
“Durante a instrução processual restou demonstrado que o denunciado Geraldo Filipe da Silva não tem nenhum tipo de vínculo com os demais autuados.”
Geraldo foi preso na Esplanada dos Ministérios enquanto era agredido pelos “integrantes da turba golpista”, diz o pedido de absolvição.
Após o óbito de Cleriston Pereira da Cunha, Moraes determinou que a direção da Papuda envie informações detalhadas sobre o caso. O presidente do STF, ministro Luís Roberto Barroso, lamentou o ocorrido e expressou solidariedade à família.
