Segundo o Código de Processo Civil (CPC) Toffoli ou qualquer outro membro do poder judiciário está impedido de julgar qualquer pedido“quando nele estiver postulando, como defensor público, advogado ou membro do Ministério Público, seu cônjuge ou companheiro, ou qualquer parente, consanguíneo ou afim, em linha reta ou colateral, até o terceiro grau, inclusive”.
