Sete deputados federais perderam seus mandatos após decisão definitiva do Supremo Tribunal Federal (STF) que considerou inconstitucional a regra das sobras eleitorais aplicada nas eleições de 2022. A determinação foi cumprida oficialmente pela Mesa Diretora da Câmara no dia 29 de julho de 2025, após meses de embate jurídico e político.
Os parlamentares cassados foram eleitos com base na Lei 14.211/2021, que restringia o acesso às sobras eleitorais a partidos que atingissem pelo menos 80% do quociente eleitoral e a candidatos com, no mínimo, 20%. Em 13 de março, por maioria de votos (6 a 5), o STF anulou a aplicação da regra naquele pleito, sob o argumento de que a norma feriu o princípio do pluralismo político ao excluir legendas menores e candidaturas com votação expressiva.
Com isso, os deputados Dr. Pupio (MDB-AP), Professora Goreth (PDT-AP), Sílvia Waiãpi (PL-AP), Sonize Barbosa (PL-AP), Lebrão (União Brasil-RO), Lázaro Botelho (PP-TO) e Gilvan Máximo (Republicanos-DF) tiveram os diplomas cassados.
A retotalização dos votos, realizada pelos Tribunais Regionais Eleitorais, resultou na convocação de novos nomes para ocupar as vagas. Assumiram os mandatos os deputados Profa. Marcivânia (PCdoB-AP), Aline Gurgel (Republicanos-AP), Paulo Lemos (PSOL-AP) e André Abdon (PP-AP), todos pelo Amapá; Rafael Bento (Podemos-RO), por Rondônia; Tiago Dimas (Podemos-TO), por Tocantins; e Rodrigo Rollemberg (PSB-DF), no Distrito Federal.
A substituição de quatro parlamentares amapaenses elevou a tensão na bancada do estado. A deputada cassada Professora Goreth classificou a decisão como “ataque à democracia”, ao afirmar que os parlamentares eleitos seguiram regras que estavam vigentes à época. Já Sílvia Waiãpi, mulher indígena e policial militar da reserva, declarou que a medida “expulsou do Congresso uma representação legítima do Norte e da Amazônia”.
O deputado Gilvan Máximo, por sua vez, prometeu protestos e chegou a anunciar uma greve de fome em reação à decisão. Ele disse ter sido surpreendido pela notificação da perda do mandato, antes mesmo de esgotar os recursos administrativos.
O presidente da Câmara, Hugo Motta, comunicou os desligamentos e novas posses sem fazer declarações públicas. Internamente, aliados avaliam que a medida do STF interfere na soberania do voto popular e cria um precedente jurídico instável, com potencial de influenciar futuras disputas eleitorais.
Entre os novos parlamentares, o retorno de nomes experientes como Rodrigo Rollemberg, ex-senador e ex-governador do Distrito Federal, foi visto como um reforço à articulação de centro-esquerda no Congresso. A posse dos sete substitutos foi marcada por cerimônias discretas, diante do caráter controverso da decisão judicial.
Juristas ouvidos por veículos da grande imprensa destacaram que o Supremo atuou para corrigir uma distorção legal que beneficiava grandes legendas e concentrava a distribuição das sobras eleitorais. Para outros, no entanto, a medida teve efeito retroativo indevido, alterando o resultado de uma eleição já consolidada.
Com a mudança, o equilíbrio das forças partidárias na Câmara sofreu ajustes pontuais, especialmente nas bancadas do Amapá e do DF. Embora os partidos atingidos tenham sinalizado que vão recorrer a instâncias internacionais, a decisão do STF é considerada definitiva dentro da jurisdição brasileira.
