A Primeira Turma do Supremo Tribunal Federal (STF) condenou os sete réus do Núcleo 4 da suposta trama golpista investigada pela Procuradoria-Geral da República (PGR). O julgamento, conduzido em sessão realizada em 21 de outubro de 2025, teve o placar de 4 votos a 1 pela condenação.
Os sete réus do Núcleo 4 são:
-Ailton Gonçalves Moraes Barros (major da reserva do Exército)
-Ângelo Martins Denicoli (major da reserva do Exército)
-Giancarlo Gomes Rodrigues (subtenente do Exército)
-Guilherme Marques de Almeida (tenente-coronel do Exército)
-Reginaldo Vieira de Abreu (coronel do Exército)
-Marcelo Araújo Bormevet (policial federal)
-Carlos Cesar Moretzsohn Rocha (presidente do Instituto Voto Legal)
Eles foram acusados pela PGR de crimes ligados à disseminação de notícias falsas e ações coordenadas para criar instabilidade institucional e favorecer uma suposta tentativa de golpe de Estado durante o governo do ex-presidente Jair Bolsonaro.
Os crimes listados são:
-Organização criminosa armada
-Tentativa de abolição violenta do Estado Democrático de Direito
-Golpe de EstadoDano qualificado pela violência e grave ameaça
-Deterioração de patrimônio tombado
O relator, ministro Alexandre de Moraes, foi o primeiro a votar, dedicando mais de duas horas e meia para a leitura do voto, no qual enfatizou a comprovação da organização criminosa e detalhou as provas contra cada réu, incluindo mensagens escritas, áudios e prints de redes sociais apontando uma suposta coordenação das ações criminosas.
Em seguida, o ministro Cristiano Zanin acompanhou integralmente Moraes, consolidando um placar inicial favorável à condenação (2 a 0).
O ministro Luiz Fux foi o único a divergir, votando pela absolvição dos sete réus, alegando ausência de provas suficientes para condenação.

Para o ministro, a mera cogitação de uma tentativa de golpe não deve ser punida.
“De qualquer sorte, ninguém pode ser punido pela cogitação. Os atos preparatórios não atraem qualquer resposta penal”, afirmou Fux. “O intérprete da lei não deve equiparar atos preparatórios aos atos executórios”.
Posteriormente, os ministros Cármen Lúcia e Flávio Dino votaram pela condenação, acompanhando o entendimento do relator e formando a maioria de 4 a 1. A ministra Cármen Lúcia disse que o núcleo de desinformação promoveu práticas delituosas que geraram irritabilidade política por meio das mídias sociais, minando a confiança necessária à democracia.
O julgamento da Primeira Turma do STF determinou a condenação dos sete réus por sua participação nas ações delituosas que visaram desestabilizar o Estado Democrático de Direito e perpetuar um golpe de Estado após as eleições de 2022.
A condenação não implicará prisão automática, pois as defesas poderão recorrer.
