O ministro Alexandre de Moraes, do Supremo Tribunal Federal (STF), assinou neste domingo (2), decisão determinando a preservação rigorosa e integral de todas as provas materiais relacionadas à Operação Contenção, a ação policial mais letal da história do Rio de Janeiro, que resultou em pelo menos 121 mortes nos complexos de favelas do Alemão e da Penha, ocorrida na última terça-feira (28).
A decisão atende a pedido da Defensoria Pública da União (DPU) e tem como objetivo garantir o controle e a averiguação das provas pelo Ministério Público, assegurando também o acesso à Defensoria Pública do Estado do Rio de Janeiro.
Moraes determinou que todos os elementos de prova, como perícias, laudos, cadeias de custódia, registros fotográficos e croquis dos locais da ação policial, sejam preservados e documentados de forma minuciosa.
Além disso, o ministro proibiu a remoção indevida de cadáveres sob justificativa de socorro imediato e ordenou que não haja descarte de peças ou objetos relevantes para a investigação criminal.
O material coletado deverá estar garantido em sistemas eletrônicos, com backup e integridade probatória preservados.Em caráter imediato, Moraes determinou que o governador Cláudio Castro seja intimado ainda nesta data para assegurar o cumprimento integral da decisão.
O ministro marcou audiência para o próximo dia 5 de novembro, às 10h, na sala da Primeira Turma do STF, para debater os fatos da operação com dezenas de entidades e órgãos da sociedade civil ligados à defesa dos direitos humanos, incluindo o Conselho Nacional de Direitos Humanos, a Comissão de Defesa dos Direitos Humanos da Assembleia Legislativa do Rio, e organizações como Conectas Direitos Humanos, Justiça Global, Movimento Negro Unificado, entre outras.
A Operação Contenção foi realizada com o objetivo de combater o Comando Vermelho, facção criminosa dominante na região, e contou com o cumprimento de 180 mandados de busca e apreensão e 100 mandados de prisão.
Oficialmente, o governo do Rio informou que a maioria dos mortos tinha envolvimento com o crime organizado,
A decisão de Moraes reforça o compromisso do Supremo em fiscalizar e garantir a legalidade, o respeito aos direitos humanos e a responsabilização em investigações policiais.
A intimação do governador é justificada para assegurar que as autoridades fluminenses cumpram o rigor exigido pelo Judiciário e colaborem com as apurações em curso.
