Texto substitutivo de Derrite foi aprovado no projeto de combate ao crime organizado
A Câmara dos Deputados aprovou na noite desta terça-feira (18) o texto substitutivo apresentado pelo deputado Guilherme Derrite (PP-SP) ao Projeto de Lei nº 5.582/2025, instituindo o chamado Marco Legal do Combate ao Crime Organizado no Brasil. O projeto foi aprovado por ampla maioria, com 370 votos favoráveis e 110 contrários, após intensos debates e negociação entre governo e oposição.
O substitutivo fortalece a repressão a organizações criminosas e milícias, introduzindo penas mais severas e novas medidas para enfrentamento dessas estruturas. Entre as principais novidades do texto estão a criação do crime de “domínio social estruturado” — conceito que abrange grupos criminosos ultraviolentos, milícias privadas e organizações paramilitares —, cuja pena varia de 20 a 40 anos de reclusão. Em casos de lideranças ou uso de tecnologia avançada, como drones, a punição pode chegar a 66 anos de prisão.

- Ampliação dos tipos penais para abarcar ações como domínio territorial, sabotagens e ataques armados, considerando-os agravantes.
- Aumento das penas para membros de facções e milícias, com regras ainda mais rigorosas para os chefes dessas organizações.
- Facilitação do bloqueio e indisponibilidade de bens, inclusive ativos digitais e em nome de terceiros, com ampliação da cooperação internacional.
- Destinação dos bens apreendidos ao Fundo Nacional de Segurança Pública em operações com participação da Polícia Federal.
- Proibição de graça, anistia, indulto ou liberdade condicional para condenados por envolvimento com organizações criminosas.
- Determinação de que líderes do crime cumpram pena em presídios federais de segurança máxima para impedir o comando externo das facções[1][3][2][6].
O projeto também reforça a atuação do Ministério Público em forças-tarefa investigativas, garantindo participação ativa inclusive do Grupo de Atuação Especial de Combate ao Crime Organizado (GAECO) e torna obrigatória a comunicação de bloqueios e movimentações suspeitas a órgãos como o COAF, Banco Central, Receita Federal e outros. O texto final não alterou a Lei Antiterrorismo, após críticas, mas manteve regras mais rígidas para a repressão ao crime organizado.

A versão final do substitutivo, segunda Derrite, foi fruto de “amplo debate democrático” e envolveu a retirada de trechos que equiparavam facções criminosas a grupos terroristas. Também foi restaurada a competência da Polícia Federal em diversos pontos investigativos e mantida a repartição de bens apreendidos entre União e estados. O relator destacou que o objetivo é sufocar financeiramente as organizações, isolar lideranças e restabelecer o monopólio estatal da força.
