Ministro do STF também determinou que deputado estadual seja afastado do cargo de presidente da Alerj e recolhimento noturno
O ministro do Supremo Tribunal Federal (STF) Alexandre de Moraes determinou nesta terça-feira (9) que o presidente da Assembleia Legislativa do Rio de Janeiro (Alerj), Rodrigo Bacellar (União Brasil), seja solto da prisão.
O ministro determinou medidas coercitivas e passe a usar tornozeleira eletrônica.
Ontem, segunda-feira (8) os deputados estaduais do Rio de Janeiro votarem para revogar a prisão do parlamentar. Foram 42 votos a favor de revogar a prisão, 21 contra e 2 abstenções — para relaxar a prisão, eram necessários ao menos 36 votos favoráveis.
Moraes acatou a decisão dos deputados cariocas, mas impôs medidas cautelares:
- Afastamento da presidência da Alerj;
- Entrega de todos os passaportes;
- Proibição de se comunicar com outros investigados;
- Suspensão de porte de arma de fogo.
- Uso de tornozeleira eletrônica e recolhimento domiciliar noturno, das 19h até 6h;
Moraes determinou que a tornozeleira para monitorar Bacellar deve ser instalada “imediatamente assim que for cumprido o alvará de soltura”.
“Assim sendo, presentes os mesmos requisitos da decretação da prisão do Deputado Estadual Rodrigo da Silva Bacellar, em face da decisão da Assembleia Legislativa do Estado do Rio de Janeiro de revogá-la, torna-se necessário a substituição da medida restritiva de liberdade por medidas cautelares que garantam a investigação criminal, a ordem pública e assegurem a aplicação da lei penal”, escreveu Moraes, na decisão.
Caso alguma das medidas seja descumprida, decidiu Moraes, deve ser aplicada multa de R$ 50 mil por dia.
Prisão de Bacellar
Bacellar foi preso no dia 3, dentro da Superintendência da PF no Rio, na Praça Mauá, após “ser convidado” para uma “reunião” pelo próprio superintendente, Fábio Galvão. O presidente da Alerj recebeu voz de prisão tão logo chegou — e seu celular foi apreendido.
A PF apreendeu R$ 90 mil no carro em que estava o deputado que ficou em silêncio quando questionado sobre o dinheiro.
A Polícia Federal (PF) prendeu Bacellar sob suspeita de ele ter vazado informações sigilosas da Operação Zargun, deflagrada em setembro, em que o então deputado estadual Thiego Raimundo dos Santos Silva, o TH Joias, foi preso por tráfico de drogas, corrupção e lavagem de dinheiro.
TH é suspeito de negociar armas para o Comando Vermelho (CV). Ele assumiu o mandato em junho, mas deixou de ser deputado após sua prisão.
