Esutáquio chegou a ser preso no Brasil, mas deixou o país após ir para o regime domiciliar
A Justiça da Espanha rejeitou um recurso do governo brasileiro e negou a extradição do jornalista Oswaldo Eustáquio – apoiador do ex-presidente Jair Bolsonaro que fugiu do Brasil e hoje vive no território espanhol.
A decisão foi da 3ª Seção da Sala Penal da Audiência Nacional da Espanha. Diante disso, a Advocacia-Geral da União informou que, como não cabe mais recurso no processo, só resta aguardar que a Justiça espanhola declare o trânsito em julgado, ou seja, determine que o caso está encerrado naquele país.
A AGU contratou um escritório espanhol para defender os interesses da União nesse processo.
Eustáquio participou publicamente dos acampamentos que pediam um golpe de Estado e, segundo a PF, chegou a se refugiar no Palácio da Alvorada com medo de ser preso.
Ele também divulgou dados pessoais do delegado que conduziu investigações sobre o ex-presidente Jair Bolsonaro – prática ilegal conhecida como “doxxing”.
O jornalista e blogueiro chegou a ser preso no Brasil, mas foi colocado em prisão domiciliar e, depois, fugiu para a Espanha.
Ele é investigado no Supremo Tribunal Federal (STF) por crimes como ameaça, perseguição, incitação ao crime, associação criminosa e tentativa de abolição violenta do Estado Democrático de Direito. Para justiça brasileira, ele está foragido.
Em abril, a Espanha rejeitou a extradição de Eustáquio em razão do critério de “dupla incidência criminal”.
O acordo entre os países exige que a conduta criminosa atribuída ao extraditado seja prevista na lei penal do Brasil e da Espanha – ou seja, um crime tipificado nos dois países.
