A decisão do ministro Alexandre de Moraes, do Supremo Tribunal Federal, de mandar a Polícia Federal intimar o presidente da Unafisco Nacional, Kleber Cabral, para depor no chamado inquérito das fake news elevou o tom de uma crise que já era institucional.
O procedimento, formalmente conhecido como Inquérito 4.781, é alvo de críticas desde sua origem e frequentemente rotulado por adversários como “inquérito da censura”, pela amplitude de seus alvos e pela concentração de poderes nas mãos do relator, o próprio Moraes.
A intimação ocorreu após Cabral conceder entrevistas criticando a operação da PF que mirou quatro auditores da Receita Federal suspeitos de acessar, sem justificativa funcional, dados fiscais de ministros do STF e de seus familiares.
Por ordem de Alexandre de Moraes, os servidores foram afastados das funções, tiveram passaportes cancelados, ficaram proibidos de deixar o país e passaram a usar tornozeleira eletrônica. A investigação aponta possível violação de sigilo funcional e vazamento de informações.
O ponto de inflexão foi a crítica pública. Em entrevista à GloboNews, Cabral afirmou haver “desproporcionalidade gritante” nas medidas cautelares e declarou que, hoje, seria “menos arriscado fiscalizar membros do PCC do que altas autoridades da República”. Para ele, decisões reiteradas suspendendo fiscalizações envolvendo ministros teriam criado um ambiente de medo na Receita Federal.
A resposta veio com a inclusão do dirigente sindical no radar do inquérito das fake news, que investiga ataques, ameaças e disseminação de desinformação contra ministros da Corte. Não está claro se Cabral figura como testemunha ou investigado, mas o fato de a oitiva ocorrer no âmbito desse inquérito — e não apenas no procedimento sobre eventual vazamento — carrega peso político e simbólico.
Desde sua instauração, em 2019, o inquérito das fake news é questionado por juristas e parlamentares por reunir, na mesma estrutura, funções de vítima, investigador e julgador, já que o próprio Supremo determinou sua abertura e conduz as diligências. Defensores sustentam que a medida foi necessária diante de ataques coordenados à instituição e da inércia de outros órgãos. Críticos veem um precedente grave e perigoso para a liberdade de expressão.
Ao ser acionado contra um presidente de entidade de classe que fez críticas duras, mas públicas e identificadas, o inquérito põe mais lenha na fogueira do debate sobre limites dos ministros do STF. A Constituição garante liberdade de expressão e o direito de crítica, inclusive às instituições. O desafio está em distinguir opinião contundente de conduta criminosa.
No plano institucional, o episódio reforça a percepção de que há um custo elevado para confrontar decisões do Supremo, especialmente em casos relatados por Moraes. Quando uma crítica a medidas cautelares resulta em convocação policial dentro de um inquérito associado ao combate à desinformação, a fronteira entre proteção institucional e intimidação passa a ser questionada.
O STF tem a missão constitucional de defender a ordem democrática. Mas essa defesa não pode prescindir da própria lógica democrática, que inclui o dissenso e a crítica aberta. Ao ampliar o alcance do inquérito das fake news para abarcar vozes que contestam decisões judiciais, a Corte fortalece a percepção comum de que responde a críticas com instrumentos de coerção, típicos de regimes ditatoriais e antidemocráticos.
Em democracias consolidadas, tribunais constitucionais são frequentemente alvo de críticas severas. O teste institucional está em suportá-las sem transformar divergência em suspeita criminal. No Brasil, o debate agora gira em torno de uma pergunta incômoda: o inquérito criado com a retórica de proteger a democracia pode, ao ser expandido, tensionar justamente as liberdades que pretende resguardar?
