Tarifas foram impostas em abril de 2025 pelo presidente norte-americano; medida pode afetar comércio internacional e economia brasileira
A Suprema Corte dos Estados Unidos derrubou, nesta sexta-feira (20), as tarifas globais impostas pelo presidente Donald Trump. A decisão trata das chamadas “taxas recíprocas”, adotadas em abril de 2025 como parte da estratégia comercial do republicano.
Por 6 votos a 3, a maioria dos ministros concluiu que a Lei de Poderes Econômicos de Emergência Internacional (IEEPA) não permite ao presidente criar tarifas por conta própria. Trump argumentava que a lei de 1977 autoriza o presidente a adotar esse tipo de medida em situações excepcionais.
“O Código dos EUA está repleto de leis que concedem ao Executivo a autoridade para ‘regular’ alguém ou algo. No entanto, o governo não consegue identificar nenhuma lei em que o poder de regular inclua o poder de tributar”, diz a deliberação da Corte.
A decisão representa um revés significativo para a Casa Branca, ao atingir um dos pilares da política externa e da agenda econômica de Trump, marcada pela defesa de barreiras comerciais como instrumento de pressão diplomática.
Na prática, a decisão da Suprema Corte derruba as tarifas de 10% ou mais que vinham sendo aplicadas desde abril de 2025 à maioria dos parceiros comerciais dos Estados Unidos.
No entanto, não são afetadas as tarifas específicas sobre importações de aço e alumínio, que também incluem produtos brasileiros, aplicadas com base na “Seção 232 do Trade Expansion Act de 1962”, uma lei voltada exclusivamente à segurança nacional.
Além da derrubada de tarifas, o governo americano pode ser obrigado a devolver parte dos bilhões arrecadados com os impostos de importação.
Segundo economista do Penn-Wharton Budget Model, esse valor pode ultrapassar US$ 175 bilhões (aproximadamente R$ 912,5 bilhões).
Ainda assim, a decisão da Suprema Corte não encerra de forma definitiva a possibilidade de novas tarifas nos EUA.
Trump já indicou que pode buscar outros fundamentos legais para impor taxas de importação, como argumentos ligados à segurança nacional ou a práticas comerciais consideradas desleais.
