Em processo recheado de autoritarismo e outros erros graves cometidos pelas autoridades, ministro e familiares estão depondo em investigação sobre suposta agressão no aeroporto de Roma
O ministro Alexandre de Moraes, do Supremo Tribunal Federal (STF), presta depoimento na tarde desta segunda-feira na superintendência regional da Polícia Federal em São Paulo. Ele está acompanhado da mulher, a advogada Viviane Barci de Moraes, das filhas e do filho, que também estão sendo ouvidos.
O depoimento é parte das investigações sobre o episódio em que Moraes e seus familiares teriam sido hostilizados por três brasileiros no aeroporto de Fiumicino, em Roma. O ministro diz que seu filho chegou a ser agredido.
O processo é ilegal, pois injúria, difamação, ameaça e lesão corporal – têm todos penas menor que dois anos de prisão, o que não permite a persecução penal no Brasil.
Mesmo assim, os depoimentos estão sendo tomados pelo delegado encarregado do caso, Hiroshi Sakaki, a partir de Brasília, por teleconferência. O superintendente em exercício da PF em São Paulo, delegado Rodrigo Sanfurgo, acompanha.
Na semana passada, a PF cumpriu abusivos e desarrazoados mandados de busca e apreensão nos endereços do trio investigado pelo entrevero no aeroporto romano.
A ação estapafúrdia e inusitada da PF foi ordenada estranhamente pela presidente do STF, Rosa Weber, e realizada pela Polícia Federal na terça-feira (18), na residência do empresário Roberto Mantovani e de sua esposa, Andréia, em Santa Bárbara D’Oeste (SP). Eles são acusados de injúria e agressão contra Moraes, o que nunca ensejou no Brasil, busca e apreensão.
O objetivo alegado na decisão que violenta o processo legal, seria colher documentos, celulares e computadores que possam auxiliar na investigação. A PF diz que a investigação apura crimes de injúria, perseguição e desacato contra o ministro.
As decisões estapafurdias na investigação demonstram um autoritarismo crescente no meio judicial.
