STF discute a descriminalização do porte de drogas em votação que está em 4 a zero pela liberação das penas
O presidente do Senado Federal, Rodrigo Pacheco acusou o Supremo Tribunal Federal (STF) de invadir competência do Poder Legislativo ao votar a descriminalização do porte de maconha para uso pessoal. “De quem se irá comprar a droga? De um traficante, que pratica um crime gravíssimo, equiparado a hediondo”, afirmou o presidente do Senado ao ressaltar que a decisão precisaria ser acompanhada de política pública para distribuição e conscientização sobre malefícios do entorpecente.
Julgamento neste sentido foi retomado nesta quarta-feira (2) pelo tribunal e suspenso depois de quatro votos a favor da descriminalização. Segundo Pacheco, cabe exclusivamente ao Congresso Nacional discutir a questão, e uma decisão do STF não pode ser contrária à lei vigente.
“Houve, a partir da concepção da Lei Antidrogas, também uma opção política de se prever o crime de tráfico de drogas com a pena a ele cominada, e de prever também a criminalização do porte para uso de drogas “, afirmou em Plenário nesta quarta.
Pacheco classificou a descriminalização, sem discussão no Congresso e sem criação de programas de saúde pública, como “invasão de competência do Poder Legislativo”.
Ele cobrou dos ministros do STF a compreensão do papel da arena política e afirmou que o Congresso está “trabalhando duramente” pelo bem do país.
Rodrigo Pacheco abriu seu comunicado reiterando que a Advocacia do Senado Federal (Advosf) elaborará embargos de declaração em face da decisão do STF de suspender a eficácia do piso nacional da enfermagem. Para ele, o recurso é uma “afirmação de cunho político” em defesa das decisões do Congresso. O presidente do Senado salientou que o Legislativo tomou a opção de fazer justiça aos profissionais de enfermagem.
“Uma lei concebida no Congresso Nacional, da forma como foi o piso nacional da enfermagem, não é razoável que possa ser revista no âmbito do Poder Judiciário”, disse.
Os embargos de declaração servem para esclarecer pontos contraditórios ou obscuros e corrigir omissões de uma decisão judicial proferida em última instância. No caso do direito civil, podem também servir para corrigir erros. Em julgamento encerrado no início de julho, o STF decidiu que o piso nacional da enfermagem para o setor público deve ser pago pelos estados e municípios apenas na medida dos repasses feitos pela União para esse fim. No caso do setor privado, o pagamento do piso ficará sujeito a negociação coletiva, e a lei será aplicada integralmente apenas se não houver acordo dentro de 60 dias (a contar da data da publicação da decisão).
