Ministério pediu documentos sobre os dois turnos das eleições de 2018 e de 2014.
O Tribunal Superior Eleitoral (TSE) respondeu nesta segunda-feira (8), que instituições que fiscalizam o processo eleitoral não têm poder de controle externo e que prazo para pedir dados de eleições anteriores já terminou.
Para o TSE, não é possível ao Ministério da Defesa ter acesso a análise e fiscalização dos documentos.
O tribunal informou ainda que as resoluções que organizaram as duas eleições anteriores estabeleciam prazos para demandas deste tipo e rejeitou cinco pedidos de informações por estarem fora da data limite.
O TSE repassou à Defesa respostas às informações solicitadas pelo ministro Paulo Sérgio Nogueira de Oliveira no dia 23 de junho. Na ocasião, ele pediu “informações técnicas preparatórias acerca do processo eleitoral”.
Foram analisadas 12 solicitações. A última delas estava dividida em 10 perguntas – destas, 5 não foram respondidas por terem sido feitas fora do prazo. O anexo com o material foi enviado com um ofício assinado pelo presidente Edson Fachin.
Em quatro pedidos de dados técnicos, o TSE informou à Defesa que não havia previsão, nas regras internas da Corte Eleitoral, para enviar as informações por escrito – e que o material poderia ser apresentado no TSE, durante a inspeção do código-fonte, ou seja, na análise dos arquivos dos programas de computador que compõem o sistema de votação.
Na resposta enviada ao Ministério, o ministro Edson Fachin afirmou que a “comunicação escrita não se presta a detalhar para as entidades fiscalizadoras elementos sobre especificação e desenvolvimento de sistemas que devam ser aferidos exclusivamente in loco na ambiência do Tribunal Superior Eleitoral”.
Ainda no documento, Fachin afirmou que o “primado da transparência” recomendam que não existam “espaços institucionais reservados ou reuniões que estejam fora do plano de ação aprovado pela Comissão de Transparência das Eleições, no primeiro semestre de 2022”.
