Notícia-crime é contra informações divulgadas em áudio, no qual o ministro Milton Ribeiro diz que repassa verbas para municípios indicados por dois pastores a pedido do presidente Jair Bolsonaro.
Os dois pastores supostamente favorecidos na distribuição de verbas do Ministério da Educação são personagens que mantêm vínculos com membros do governo.
O ministro da Educação, Milton Ribeiro, afirma na gravação: “Minha prioridade é atender primeiro os municípios que mais precisam e, segundo, atender a todos os que são amigos do pastor Gilmar”, conforme segundo disse, pedido do presidente Jair Bolsonaro.
Em um dos documentos enviados ao STF, o líder da Minoria na Câmara, deputado Alencar Santana Braga (PT-SP), pede que, se confirmadas irregularidades, Milton Ribeiro seja afastado do cargo.
O pedido solicita ainda um parecer da Procuradoria-Geral da República (PGR) sobre o tema.
“O Ministério da Educação não pode ser utilizado como instrumento de propaganda ideológica do governo federal, muito menos como um local para troca de favores e agrados a aliados do presidente da República”, afirma o pedido da oposição.
O senador Randolfe Rodrigues (Rede-AP) também enviou uma notícia-crime ao STF para pedir a investigação das condutas de Milton Ribeiro, dos pastores citados e do presidente Jair Bolsonaro.
“Não se pode admitir que o Ministro da Educação transforme um dos Ministérios mais relevantes para o futuro do País e de maior peso orçamentário em um verdadeiro balcão de negócios. A distribuição de recursos públicos afetos à referida pasta ministerial não pode ser feita às escuras, sem a observância dos princípios constitucionais da impessoalidade e da eficiência, buscando beneficiar os amigos do rei”, diz o documento.
Randolfe pede que Ribeiro e Bolsonaro sejam investigados pelos crimes de peculato, emprego irregular de verbas ou rendas públicas, corrupção passiva, prevaricação e advocacia administrativa.
Os pastores, segundo Randolfe, devem ser investigados por tráfico de influência e corrupção ativa. E os servidores do MEC apontados como supostos integrantes de um “gabinete paralelo”, investigados por usurpação de função pública.
O PSOL informou que acionou o Ministério Público para pedir que o ministro e Bolsonaro sejam investigados, além dos dois pastores.
“A atuação do ministro Ribeiro, seguindo as diretrizes de Bolsonaro e seus apoiadores mais influentes, longe do que preconiza a boa atuação do servidor público, atende a interesses particulares e pessoais, e não ao interesse público”, afirmou o PSOL na representação.
O partido diz ainda que podem ter sido cometidos os crimes de tráfico de influência, prevaricação e advocacia administrativa.
Câmara
Na Câmara, dois deputados apresentaram requerimentos que pedem a convocação do ministro para prestar esclarecimentos ao plenário. A bancada do partido Novo na Câmara também fez pedido semelhante.
Um dos requrimentos é do deputado Ricardo Silva (PSB-SP). Ele argumenta que atuações de pessoas sem cargo ou função pública na liberação de recursos do Fundo Nacional de Desenvolvimento da Educação (FNDE) podem caracterizar crime de responsabilidade ou tráfico de influência.
“Tais atitudes são totalmente dissonantes ao corte das verbas da educação que, apenas no atual governo, teve o menor orçamento da educação da década”, afirma no pedido
A deputada Luizianne Lins (PT-CE), autora de outro requerimento, diz que o episódio “afronta o republicanismo constitucional e fere princípios democráticos”.
“O mais grave é a afirmação de que este foi um pedido especial do Presidente da República, fato que agride a ética, a Carta Magna e demonstra o caráter fisiológico do governo Bolsonaro”, destaca na peça.
A votação dos requerimentos de convocação depende de inclusão na pauta pelo presidente Arthur Lira (PP-AL). Conforme o regimento interno, para serem aprovados, precisam ter voto da maioria dos deputados presentes na sessão de votação.
Senado
Entre os senadores, Fabiano Contarato (PT-ES) apresentou ao Supremo Tribunal Federal (STF) uma notícia-crime em que pede a investigação de Milton Ribeiro.
“Resta claro que o ministro da Educação, ao conceder liberação célere de recursos, priorizando atender ‘a todos que são amigos do Pastor Gilmar’, patrocina ou apadrinha diretamente interesse privado perante a administração pública, valendo-se para isso da sua qualidade de funcionário público, o que configura crime de advocacia administrativa”, afirmou o petista.
Alessandro Vieira (PSDB-SE), juntamente com os deputados Felipe Rigoni e Tabata Amaral (PSB-SP), apresentou na Procuradoria Geral da República uma representação contra o ministro da Educação.
O presidente do Senado, Rodrigo Pacheco (PSD-MG), disse não ter elementos para fazer uma avaliação do caso.
“Todos os ministérios devem tratar de maneira isonômica, levando em conta os melhores interesses de todos os estados e municípios do Brasil. Eu confio nisso, confio que o Ministério da Educação não vai fugir a essa regularidade e a essa rotina de tratar todos de forma igual. É o que eu espero. É um caso a ser explicado, esclarecido, demonstrar que não há qualquer tipo de favorecimento. Sobretudo, dar o crédito ao ministro para que ele possa fazer a explicação devida”, declarou.
