Voto do ministro Roberto Barroso forma maioria para tornar réus mais de 200 denunciados no STF
O Supremo Tribunal Federal (STF) formou maioria na noite desta quinta-feira (27) para tornar réus mais 200 denunciados pela Procuradoria-Geral da República (PGR) como supostos incitadores e executores de atos antidemocráticos no dia 8 de janeiro.
A votação, em plenário virtual, começou na última terça-feira (25/4) e vai até o próximo dia 2. Como o ex-ministro Ricardo Lewandowski se aposentou no último dia 11 e ainda não foi apontado um substituto, a maioria de magistrados é formada por cinco ministros. Esse número foi alcançado nesta quinta-feira, após três dias de julgamento.
Até o momento, Alexandre de Moraes, Dias Toffoli, Edson Fachin, Cármen Lúcia, Luiz Fux e Luiz Roberto Barroso votaram a favor de tornar réus os denunciados. O próximo passo é a coleta de provas e a realização de depoimentos de testemunhas de defesa e condenação.
Os denunciados respondem por crimes como associação criminosa armada, abolição violenta do Estado Democrático de Direito, golpe de Estado, dano qualificado pela violência e grave ameaça com emprego de substância inflamável contra o patrimônio da União e com considerável prejuízo para a vítima e deterioração de patrimônio tombado.
A votação começou às 0h de terça-feira (25), no plenário virtual. Logo nos primeiros minutos, Alexandre de Moraes, relator dos inquéritos julgados, depositou seu voto.
Em seu voto, o magistrado afirmou que a liberdade de expressão não confere a manifestações como as ocorridas no dia 8 de janeiro.
“São inconstitucionais as condutas e manifestações que tenham a nítida finalidade de controlar ou mesmo aniquilar a força do pensamento crítico, indispensável ao regime democrático, quanto àquelas que pretendam destruí-lo, juntamente com suas instituições republicanas, pregando a violência, o arbítrio, o desrespeito à separação de Poderes e aos direitos fundamentais, em suma, pleiteando a tirania, o arbítrio, a violência e a quebra dos princípios republicanos, como se verifica pelas manifestações criminosas ora imputadas ao denunciado”, escreveu o ministro em seu voto.
O voto manteve a linha que Moraes declarou na última semana, quando a primeira leva de supostos incitadores e executores dos atos foi indiciada pelo Supremo.
Em seguida, Dias Toffoli, Edson Fachin, Cármen Lúcia, Luiz Fux e Barroso votaram, também a favor de tornar réus os denunciados.
