Vice-Procuradora Geral da República acusou o ministro do Supremo do Supremo Tribunal Federal (STF) de violar sistema processual acusatório ao dar ordens em inquérito
“No caso concreto, o eminente Ministro Relator, data venia [com o devido respeito], acabou por violar o sistema processual acusatório, na medida que decretou diligências investigativas e compartilhou provas de ofício, sem prévio requerimento do titular da ação penal pública e até mesmo da autoridade policial que reputou concluída a investigação, além de não apreciar a promoção de arquivamento do Procurador-Geral da República” escreveu a vice-PGR.
O despacho foi enviado ao STF, nesta segunda-feira (1º), no inquérito sobre vazamento de dados de investigação da Polícia Federal, que teria sido cometido pelo Presidente da República, Jair Bolsonaro.
Lindôra também nega que a atuação do chefe da PGR, Augusto Aras, tenha sido irregular ao pedir o encerramento da investigação. Para a procuradora, o colega atuou de forma técnica, jurídica, isenta sem “qualquer desiderato [desejo] de prejudicar ou beneficiar determinadas pessoas”.
Em agosto de 2021, o presidente divulgou nas redes sociais a íntegra de um inquérito da Polícia Federal que apura suposto ataque ao sistema interno do TSE em 2018 – e que, conforme o próprio tribunal, não representou qualquer risco às eleições. Por lei, qualquer servidor público tem obrigação de proteger informações sigilosas.
