TSE forma maioria para tornar Bolsonaro inelegível
O Tribunal Superior Eleitoral formou maioria que condena o ex-presidente Jair Bolsonaro a ficar por 8 anos inelegível.

Bolsonaro responde por abuso de poder político e uso indevido dos meios de comunicação, em razão da reunião com embaixadores estrangeiros na qual ele atacou, sem provas, o sistema eleitoral.
Então presidente e pré-candidato à reeleição, Bolsonaro fez declarações sem provas que colocavam em dúvida a segurança das urnas e do processo eleitoral. A reunião foi transmitida pelo canal oficial do governo e nas redes sociais de Bolsonaro.
O Ministério Público eleitoral pediu a condenação e a inelegibilidade de Bolsonaro.
A defesa de Bolsonaro disse ao TSE que a reunião com embaixadores não teve caráter eleitoral.
O relator, ministro Benedito Gonçalves, votou na terça-feira (27). Ele considerou Bolsonaro culpado e entendeu que ele deve ficar inelegível por 8 anos.
Três ministros até agora concordaram com o relator: Floriano Marques, André Tavares e Cármen Lúcia. Um ministro votou pela absolvição: Raul Araújo.
O placar, portanto, está 4 a 1 pela condenação.
Faltam os votos de dois ministros: Nunes Marques e Alexandre de Moraes.
Qualquer ministro pode pedir vista, ou seja, mais tempo para analisar o processo, o que levaria a conclusão do julgamento para daqui a 90 dias. Mas não há essa expectativa no TSE.
Se a maioria dos ministros concordar com o relator, as acusações contra Bolsonaro, será declarado inelegível e não poderá concorrer às eleições municipais de 2024 e às estaduais e nacionais de 2026.
No entanto, o ex-presidente não seria preso, porque essa ação no TSE não é do âmbito penal.
Mesmo sendo condenado no TSE, Bolsonaro pode recorrer ao próprio TSE ou ao Supremo Tribunal Federal (STF).
A defesa do ex-presidente já sinalizou que pretende recorrer de uma eventual condenação.
Há duas possibilidades de recursos:
- Embargos de declaração
Recurso que seria enviado ao próprio TSE. Nesse instrumento, a defesa aponta obscuridades e contradições, na tentativa de reverter um eventual resultado pela inelegibilidade e preparar terreno para outro recurso ao STF.
Um recurso extraordinário pode ser enviado ao STF. O documento precisa apontar que uma eventual decisão do TSE pela inelegibilidade feriu princípios constitucionais. O advogado de Bolsonaro, Tarcísio Vieira, afirmou que já vê elementos para esse recurso, seguindo na linha à restrição do direito de defesa.
Os dois recursos têm prazo de três dias. Mas, se for apresentado primeiro o embargo de declaração, o prazo para o recurso extraordinário deixa de contar.
Antes de chegar ao STF, o recurso é apresentado ao próprio TSE, onde caberá o presidente Alexandre de Moraes verificar se os requisitos formais foram preenchidos.
Uma vez que o caso chegue à Suprema Corte, os ministros que atuaram no julgamento no TSE não participam do sorteio para a relatoria, mas não estão impedidos de votar no caso quando for a plenário.
