Brasil não pode aceitar calado tamanha distorção e afronta direta à Constituição, justamente por quem deveria ser seu guardião

Em uma decisão que escancara o abismo entre o discurso de moralidade pública e a prática do poder, o Supremo Tribunal Federal (STF) formou maioria para validar a nomeação de parentes de políticos em secretarias e ministérios.
A decisão, que na prática desmonta parte do princípio da impessoalidade administrativa, soa como um salvo-conduto para o velho vício da política brasileira: o nepotismo à luz do dia, agora com chancela da mais alta Corte do país.
A tese vencedora sustenta que cargos de natureza política — como secretários municipais, estaduais e ministros — estariam fora do alcance da proibição prevista na Súmula Vinculante 13, que veda o favorecimento de parentes em funções públicas, baseada na Constituição.
Na teoria, trata-se de uma alegada exceção “técnica” para funções políticas. Mas, na realidade brasileira, onde alianças se costuram em torno de famílias, compadrios e apadrinhamentos, o resultado é inequívoco: o campo livre para a multiplicação de dinastias familiares sustentadas por recursos públicos.
Essa casta coligada com esse tipo de integrantes do Supremo, que presenciamos desgraçadamente hoje, vai se fechar ainda mais em seus próprios núcleos e garantir emprego para incompetentes parentes de irresponsáveis eleitos.
O que o STF legitimou vai além de um simples ajuste de interpretação. É a criação de uma nova Lei. A lei da irresponsabilidade, da pessoalidade, do imoralismo e de outros inpublicáveis subjetivos e adjetivos apropriados.
É uma mensagem simbólica — e perigosa — de que a ética republicana pode ser relativizada ao sabor da conveniência política. Assim como o STF vem tomando decisões estapafúrdias ao arrepio da lei e sem a menor vergonha, ao contrário com a gora habitual arrogância de quem finge defender a carta magna. Balela. Eles foram colocados lá por marginais mal intencionados. Marginais eleitos pelo própio povo desinformado e desatento. Veja que ironia.
Governadores e prefeitos, doravante, podem indicar irmãos, esposas, sobrinhos e filhos para chefias de secretarias sob o argumento de “confiança política”.
Lula agora pode criar mais uma dúzia de ministérios para dar vaga aos seus 5 filhos e sete irmãos como ministros de Estado. Isso se ele não quiser nomear ministros dezenas de sobrinhos e quem sabe outra centena de familiares. E quem ousar questionar, que recorra, em vão, à própria Corte que liberou o caminho do escracho da coisa pública. E não estão nem aí para a opinião pública. Eles podem. O povo analfabeto lhes deu esse poder.
Sob o véu da tecnicalidade jurídica, o Supremo selou uma ruptura com o espírito de moralização administrativa que marcou decisões anteriores. O argumento de que ministros e secretários são “cargos políticos” é, no mínimo, uma cortina de fumaça: o problema não está no cargo, mas no uso indevido dele para beneficiar laços de sangue com dinheirodo povo.
Em um país onde prefeitos já nomeiam filhos como secretários de obras e governadores entregam pastas a esposas e irmãos, a fronteira entre família e Estado praticamente desaparece e agora “legalmente” apesar de imoral.
Em um momento em que o país clama por transparência e decência na gestão pública, o STF, armadl da mais alta imoralidade, em vez de erguer um muro contra os abusos, abre os portões. O resultado prático será o fortalecimento dos feudos políticos e o enfraquecimento da meritocracia — tudo com o selo de “legalidade” concedido por quem deveria ser o guardião da Constituição.
E assim, com apenas algumas linhas de voto, o Supremo transformou o princípio da impessoalidade em letra morta e reacendeu a chama do patrimonialismo brasileiro. No novo cenário, o nepotismo não será mais um pecado administrativo — será política de família, garantido por im STF para lá de anticonstitucional.
O nepotismo é uma prática considerada inconstitucional por violar os princípios da administração pública previstos no artigo 37, caput, especialmente os da moralidade, impessoalidade e igualdade. E daí? Diz o STF para o povo.
O texto Constitucional do artigo 37 estabelece que:“A administração pública direta e indireta de qualquer dos Poderes da União, dos Estados, do Distrito Federal e dos Municípios obedecerá aos princípios de legalidade, impessoalidade, moralidade, publicidade e eficiência.”
Esse STF, bem disse o advogado e ex-senador Demostenes Torres, em recente julgamento do 8 de janeiro, faz novamente uma “ginástica semântica” e enfia não sei onde o significado da impessoalidade exigida na Constituição.
